responsible for monitoring how the Organic Material will be diverted at selected <br />facilities and for selecting alternative facilities if necessary to ensure full Diversion <br />credit. Failure to do so places the Contractor in default. City has the option, but not <br />obligation, to direct Contractor where to deliver the material, and if City directs <br />Contractor to an alternative Facility then Contractor may request a rate adjustment in <br />accordance with Section 2.10.2. <br />4.6.4 Bulky Item Diversion <br />Bulky Items Collected by Contractor in accordance with Sections 4.2.10 and 4.3.14, or <br />otherwise Collected under this Agreement, may not be landfilled or disposed of until <br />the following hierarchy of Diversion efforts has been followed by Contractor: <br />1) Reuse as is <br />2) Transport Bulky Items and reusable items to the appropriate facility for reuse, or <br />processing <br />3) Disassemble for reuse or Recycling <br />4) Recycle or market and sell Recyclable Materials for Recycling <br />5) Transport Yard Waste to the appropriate facility for Processing <br />6) Disposal <br />This hierarchy is intended to preclude the use of front or rear loading packer vehicles <br />for Bulky Items unless the compaction mechanism is not used to compact the Bulky <br />Items, unless they have been designated for Disposal. <br />4.6.5 Construction and Demolition Debris Diversion <br />Contractor will bring all loads of mixed Construction and Demolition Debris to a <br />properly permitted construction and demolition debris processing Facility selected by <br />Contractor for separation and recovery of this material. Contractor may deliver <br />separated loads of Construction and Demolition Debris, such as clean dirt, concrete or <br />rebar, to facilities specializing in the reuse of such materials, provided this material is <br />Diverted from landfilling.
