(Requires five affirmative votes) <br />MINUTES: City Manager Kristine Ridge noted that there is no presentation and that <br />staff is available to answer any questions. <br />Mayor Sarmiento opened the public hearing at 9:52 p.m. <br />Clerk of the Council, Daisy Gomez, noted that there was no written correspondence <br />received or in -person request to speak on item. Note for the record: Letter submitted <br />by Mark Rosen was included as part of the staff report packet when the agenda was <br />published. <br />Mark Rosen, attorney for property owner, Metro Star, noted he submitted a letter and <br />asked Council to allow the development process to proceed and postpone <br />recommended action until June. <br />Mayor Sarmiento closed the public hearing at 9:55 p.m. <br />City Manager Kristine Ridge noted the action is adopting a resolution of necessity <br />and that staff will continue to work with the property owner. <br />This Public Hearing Item - Resolution No. 2022-013 was approved. <br />Moved by Councilmember Phan, seconded by Councilmember Penaloza to <br />Adopt. <br />YES: 6 — Hernandez, Councilmember, — Mendoza, Councilmember, — Penaloza, <br />Councilmember, — Phan, Councilmember, — Bacerra, Mayor Pro Tem, — Sarmiento, <br />Mayor <br />NO: 1 — Lopez, Councilmember <br />ABSTAIN: 0 <br />ABSENT:0 <br />Status: 6 — 1 — 0 — 0 — Pass <br />18.
