CUP No. 2022-11 – Roquette Café & Bistro <br />July 25, 2022 <br />Page 3 <br />2 <br />8 <br />2 <br />0 <br />The purpose of regulating establishments that sell alcoholic beverages is to set forth <br />operating practices and procedures and to minimize impacts to surrounding areas. Staff <br />has reviewed the applicant’s request to sell beer and wine under a Type 41 ABC License <br />and has determined that the proposed CUP will not be detrimental to the health, safety, <br />and welfare of the community. <br />The proposed sale of beer and wine for on premise consumption is consistent with several <br />goals and policies of the General Plan. Policy 1.1 of the General Plan Land Use Element <br />encourages development that fosters compatibility between land uses to enhance <br />livability. The eating establishment would be located within a suite previously occupied by <br />similar land uses where the ABC License would not alter the nature of the business or <br />introduce new impacts but expand the offerings of the establishment. Additionally, the <br />proposed license would afford the business the opportunity to offer additional products to <br />the surrounding community and encourage livability for the employees of the building and <br />neighboring residents. Therefore, the proposed project also supports Goal 1 and 2 of the <br />Land Use Element to provide a land use plan that improves quality of life, respects the <br />existing community, and provides a balance of land uses that meet Santa Ana’s diverse <br />needs. <br />The proposed sale of beer and wine for on premise consumption will not be detrimental <br />to the health, safety, and welfare of the community. Policy 2.6 of the Land Use Element <br />promotes rehabilitation of properties and encourages increased levels of capital <br />investment to create a safe and attractive environment. In line with this policy, the <br />applicant is proposing to make onsite improvements to include new finishes, furnishings, <br />and replacing the existing patio enclosure with a glass and wrought iron railing to open <br />up the space. Furthermore, Policy 2.7 of the Land Use Element supports land use <br />decisions that encourage the creation, development, and retention of business in Santa <br />Ana. Allowing the business the ability to serve beer and wine along will allow Roquette <br />Café & Bistro to enhance business offerings and compete with nearby full-service <br />restaurants that offer similar services thus support the creation of the new business. <br />Moreover, Policy 4.1 of the Land Use Element supports developments promote complete <br />neighborhoods by encouraging a mix of complementary uses, community services, and <br />people place within a walkable area. Approval of this CUP would promote the success of <br />the eating establishment that would offer various goods within a walkable distance for <br />employees or neighboring residents. The establishment will comply with the operational <br />standards set forth in Section 41-196(g) of the SAMC, which will mitigate impacts to public <br />health, safety, and welfare. Therefore, staff recommends approval of the proposed CUP. <br />Police Department Analysis <br />The Police Department reviews CUP applications for the sale and service of alcoholic <br />beverages in order to ensure that the potential crime and nuisance behaviors associated <br />7/25/2022 <br />Planning Commission 3 –3
