In July of 2021, the church started utilizing the administrative office <br />space, which a use allowed by right <br />On July 6, 2021, the applicant submitted a development project application to the City for <br />the change of use from office to a church. Since then, the applicant has worked with the <br />City’s Development Review Committee (DRC) to ensure the project complies with current <br />regulations. <br />On April 11, 2022, a request for a Conditional Use Permit to establish a church was denied <br />by the Planning Commission without prejudice. As such, the applicant has submitted a <br />new application with an updated operational plan (Exhibit 7) to address the concerns <br />raised by the Commission that were primarily related to program offerings. Based on the <br />operations, the proposed use would provide a service or facility that would contribute to <br />the general well-being of the neighborhood, and community. Additionally, the use will not <br />adversely affect the General Plan or any specific plan of the City. <br />Project Analysis <br />CUP requests are governed by Section 41-638 of the SAMC. CUPs may be granted when <br />it can be shown that the proposed project will not adversely impact the community. If <br />these findings can be made, then it is appropriate to grant the CUP. Conversely, the <br />inability to make these findings would result in a denial. <br />The proposed church, Compass Bible Church currently operates temporarily from the City <br />of Tustin and approval of the subject application would give the church the opportunity to <br />provide a permanent location for their diverse congregation, which includes current <br />residents of the City of Santa Ana. The church would occupy a 23,844 square foot tenant <br />space previously occupied by an industrial use. The project site is located within an <br />integrated professional and light industrial area approximately 0.26 miles (1,385 feet) from <br />the nearest sensitive land use. <br />The change of use from industrial to church would result in an increase of onsite parking <br />by 16 on-site spaces, however, the site has a shared parking agreement between all of <br />the buildings on the Daimler Street block (between Deere and Alton Avenues) that allows <br />the use of the parking spaces. Table 3 illustrates the anticipated parking demand based <br />on the on-site mix of uses. Furthermore, church services would be primarily offered during <br />weekends and weeknights and is not anticipated to conflict with professional office and <br />light industrial uses based on hours of operation (Table 4). Additionally, weekday hours <br />of operation, the church is limited to office use and small group bible study; therefore, <br />parking is not anticipate to create new impacts to the surrounding uses. <br />8/22/2022 <br />Planning Commission 1 – 3
