WELCOME TO THE NEIGHBORHOOD <br />Snapshot of Litigation Coasts <br />Two examples of cities being involved in lengthy and costly lawsuits include Newport <br />Beach and Costa Mesa. In 2007, Newport Beach had numerous sober living homes and <br />was facing increasing pressure by residents to regulate them. In January 2008, Newport <br />Beach passed an ordinance, regulating sober living homes. The ordinance was carefully <br />crafted to comply with State and federal law.15 <br />-By-November-2008, several legal actions occurred. -These included: - <br />- - 1.:A lawsuit from a residents' group (the "Concerned Citizens of Newport Beach" or <br />CCNB) arguing that the City did not go far enough in enacting Ordinance 2008- <br />_-05. CCNB.:also sued multiple operators and asked for $250 million in damages <br />from the City; <br />:-._:-.-2.. Two -group h.or ie-operators (Pacific Shores Recovery and Sober Living by the <br />- Sea) filed complaints with the US Department of Housing and Urban <br />.Development (HUD) alleging that the City's ordinance and its practices have <br />discriminated against disabled persons entitled to fair housing; <br />:. 3. Multiple lawsuits were filed by Sober Living By the Sea (SLBTS) alleging that the <br />- - - - - City's group residential uses ordinance was facially discriminatory against <br />persons.in. recovery. The City reached an agreement with SLBTS; <br />4. The Cityfiled lawsuits against Morningside Recovery and Pacific Shores <br />- - -- -- Recovery, alleging that some of their operations opened illegally during a short- <br />_ term temporary moratorium against the establishment of new group residential <br />_- uses. Pacific Shores Recovery has in turn alleged that the City's group <br />ORANGE COUNTY GRAND JURY 2022 1 2023 Page 14 of 42 <br />
