Ciry representative contacts Helpmates for temporary services and provides the jab title and any <br />special skills or required experience and: Certain positions may require bilingual skills. Helpmates <br />will provide temporary worker (s) as required and approved by City departments to work at the <br />various City of Santa Ana department locations. <br />2. Helpmates will compare job requirements with worker qualifications and will email resume(s) and <br />test results of temporary workers as requested. <br />3. Helpmates will Follow up with the City within two (2) hours to provide name (s) for City approval. <br />If Helpmates is unable to locate a qualified candidate within (4) hours of the initial request, the <br />City reserves the right to contact other temporary agencies far placement. <br />4. Once a candidate is selected, and the hourly pay rate has been agreed upon, Helpmates shall <br />provide the City with a detailed proposal to include the specific jab description, the hourly pay <br />rate for the temporary worker, and the mark-up rate. The City shall then review and sign the <br />proposal if approved. <br />5. All invoices will include agreement number, requesting city department, department contact <br />name/requester name, candidate name, hourly pay rate and mark-up rate, dates of assignment <br />duration and total hours worked during the duration of assignment. <br />6. Helpmates will provide temporary workers who have the skills required for the assignment. <br />We have the capability and flexibility to accommodate what is easiest for the City, both now and as <br />circumstances and procedures change. <br />In addition Helpmates understands and agrees; <br />7. The City reserves the right to end a Temp's assignment if work performed is substandard, <br />attendance is poor, or for other business related reasons. <br />8. We shall remove any temporary worker for assignment at City's request, at the specified time and <br />date and will provide a replacement temporary worker if required by City. <br />9. We shall be responsible for all decisions concerning matters of hiring; firing; discipline; payroll <br />practices; and employee benefits such as vacation, sick, and other leave benefits. Temporary <br />workers provided by Helpmates shall be considered employees of Helpmates and shall in no sense <br />be considered employees or agents of the City. <br />10. We shall be responsible for communication with temporary workers with respect to their duties as <br />employees of Helpmates. <br />11. We will provide the City with testing resources for regular status positions as requested. These <br />services shall be provided at the rates set forth in Cost Proposal Form, ATTACHMENT G. <br />12. Individual temporary workers are not permitted to work more than 960 hours in any fiscal year <br />period (July 1 - June 30). Contractor is solely responsible for tracking hours worked by all <br />temporary workers, and to notify the department contact and the Human resources Department <br />within 30 working days of any temporary worker reaching the limit of 960 hours. <br />13. Helpmates will comply with all applicable local, state, and federal laws and regulations, including <br />California Assembly Bill 1028 (Effective January 1, 2012) and CaIPERS rules regarding CaIPERS <br />Retired Annuitants, whether formerly employed by the City or other public agency employers <br />subscribing to Ca1PERS. Helpmates will ensure that no employee provided under this agreement <br />would need to be reinstated to CaIPERS employment or considered to be in violation of the <br />retirement law or otherwise in unlawful employment as a result of their work at the City prior to <br />assigning any temporary worker to any City request. <br />RFR No. 23-051 Temporary Staffing Services Page 4 of 18 <br />
