<br />they had previously held in the prior rate range and shall retain credit for length of service <br />in such step towards advancement to the next higher step. <br />5.13 Acting Pay. Acting pay shall be defined as the temporary assignment of an employee to <br />perform work of a job class (represented by SAMA) which is assigned to a higher salary <br />schedule than their regular job class. An employee who is temporarily appointed by the <br />Executive Director to serve in an acting capacity for two (2) weeks or more and who is <br />responsible for the full range duties and responsibilities assigned to the higher level <br />classification, shall receive a five percent (5%) increase or the minimum salary of the <br />higher level classification (whichever is higher) for all time worked in the higher job <br />classification. <br />A. Bargaining unit employees temporarily assigned to serve in an acting capacity of an <br />Executive Management (Executive Director) classification for thirty (30) calendar <br />days or more and who is responsible for the full range of duties and responsibilities <br />assigned to the Executive Management position shall receive a ten percent (10%) <br />increase or the minimum salary of the Executive Management classification <br />(whichever is higher) for all time worked in the higher job classification. <br />B. An employee must be qualified (i.e. meet the minimum qualifications) for the higher <br />position in order to be paid for acting pay. The determination of those persons <br />qualified for work in higher rated classifications shall be established and determined <br />by the Executive Director of Human Resources or designee. <br />a. The Executive Director of Human Resources or designee’s determination is final <br />and binding and shall not be appealable. <br />C. Non-permanent employees (probationary, seasonal, temporary, limited-term, etc.) <br />shall not be eligible for acting pay. <br />D. Each assignment may be terminated at any time, but in no event shall such assignment <br />continue beyond one hundred and eighty (180) calendar days or nine hundred and <br />sixty (960) hours each fiscal year, whichever comes first. <br />SANTA ANA MANAGEMENT ASSOCIATION (SAMA) MOU: 2022-2025 17
