<br />ARTICLE VI <br />6.0 ADDITIONAL COMPENSATION <br />6.1 Bilingual Pay. An employee whom the Executive Director or their designee assigns to a <br />position requiring bilingual capability in both English and either Samoan, Spanish, <br />Vietnamese, or other languages designated by the City Manager, will be paid a monthly <br />premium in accordance with the criteria and amounts set forth below: <br />A.Certification by the Executive Director of Human Resources as having <br />satisfactorily demonstrated conversational fluency in both languages for any <br />position requiring bilingual capability. <br />B.Positions for which the Executive Director has determined that bilingual <br />proficiency is essential to carry out duties and responsibilities of a critical and/or <br />emergency nature without ready access to backup assistance, or positions where <br />bilingual public contact is a major and essential element of the work being <br />performed, will be designated as Primary Bilingual Assignments. A qualified <br />incumbent of such position will be paid a monthly premium of one hundred <br />seventy-five dollars ($175) above their then current base monthly salary step. <br />C.Positions where it has been determined by the Executive Director that regular and <br />frequent bilingual usage is necessary to the performance of duties, but not a major, <br />essential or integral element of the work, will be designated as Secondary Bilingual <br />Assignments. A qualified incumbent of such position will be paid a monthly <br />premium of forty dollars ($40) above their then current base monthly salary step. <br />D. <br />E. <br />The number of such Primary and/or Secondary Bilingual Assignment shall be no <br />larger than the requirements of the department as determined by the Executive <br />Director and the City Manager. <br />Employees who receive bilingual assignment pay at the time this 2022-2025 MOU <br />is adopted by the City Council shall recertify their bilingual capability every three <br />(3) years with the first recertification conducted beginning in July 2025. Employees <br />who do not successfully pass required recertification examinations shall have their <br />bilingual assignment pay removed. Unsuccessful employees may retake the <br />required certification exam every three (3) months. <br />F.Employees who are initially certified for bilingual assignment pay after this 2022- <br />2025 MOU is adopted by the City Council shall recertify their bilingual capability <br />every three (3) years after the date of initial certification. Employees who do not <br />successfully pass required recertification examinations shall have their bilingual <br />SANTA ANA MANAGEMENT ASSOCIATION (SAMA) MOU: 2022-2025 18
