<br />of two thousand (2,000) hours, at the rate of base pay effective on the date <br />of such termination. <br />6.Employees who notify the City, in writing, of their intent to retire within <br />twelve (12) calendar months shall be allowed to cash out any eligible sick <br />leave bank balances (Section 10.1K) upon request. Employees shall receive <br />payment the first paycheck in January after the request has been made. If <br />said employee cashes out their eligible sick leave bank balances prior to <br />retirement and subsequently does not retire from the City, all future sick <br />leave accrual for said employee shall be subject to the same cash out <br />provision elected and will be processed on the final paycheck. All combined <br />cash outs cannot exceed what the said employee would have been entitled <br />to if the cash out was processed on the final paycheck only. <br />7.Employees with at least ten (10) years of full-time city service that retire <br />from the City of Santa Ana within one hundred and twenty (120) days of <br />separation shall be eligible to convert up to two-thousand (2000) hours of <br />accumulated unused sick leave to CalPERS Service Credit as defined in <br />Section 13.3. <br />Effective the date of City Council adoption of this 2022-2025 MOU, the <br />maximum total unused sick leave that can be converted shall be ten (10) <br />eight (8) hour working days equal to eighty (80) hours. Employees hired <br />on or after a contract amendment between the City and CalPERS shall not <br />be eligible to convert unused sick leave to CalPERS for service credit. <br />8. <br />9. <br />The City Manager is authorized to grant a newly appointed incumbent of a <br />SAMA classification sick leave credit up to an amount equal to any earned <br />but unused sick leave credit available to such appointee at the time of their <br />separation from their most recent previous employer. <br />A lump sum payment shall be made to the beneficiaries of any eligible <br />employee whose death occurs while such employee is an active employee <br />of the City, such payment to be in the amount of one-third (1/3) of the total <br />sick leave benefit credited to the employee’s account at the time of their <br />death, and at the rate of pay effective on the date of death. <br />10.2 Bereavement Leave. <br />A. An employee shall be granted up to three (3) days leave without loss of pay in case <br />of death of a member of the employee’s immediate family.
