Sunshine Ordinance Amendments <br />May 16, 2023 <br />Page 2 <br />3 <br />3 <br />6 <br />1 <br />3) Include accountability measures to ensure required meetings, timelines, and <br />deliverables are adhered to and provided in a timely manner. <br />4) Update notification radii to increase transparency. <br />5) Require Spanish interpretation at all community meetings in addition to <br />maintaining a provision allowing community members to request interpretation <br />services in languages other than English and Spanish. <br />Table 1 on the following pages illustrates the existing and proposed text amendments to <br />the Sunshine Ordinance to address City Council desired changes: <br />Table 1: OA No. 2023-01 Sunshine Ordinance Amendments <br />Topic Existing Regulations Proposed Ordinance Amendments <br />Compliance with <br />Community Meeting <br />Requirements <br />Section 2-153(b) specifies <br />sequence/timeline of processing <br />applications that are subject to the <br />Sunshine Ordinance. <br />Specify that if an applicant fails to hold <br />the required meetings: <br />•Deem the application <br />resubmittal incomplete, and <br />•Require all meetings to be <br />held and comply with the <br />established timelines before <br />deeming an application <br />complete. <br />Noticing Section 2-153(c) requires noticing to <br />property owners and occupants of <br />residential units within a 1,000-foot <br />radius of the project site. <br />For projects subject to Sunshine <br />Ordinance: <br />•Expand the noticing radius to <br />2,000 feet for properties <br />located within the City of Santa <br />Ana boundary, and <br />•Revise the noticing radius to <br />300 feet for properties outside <br />the City boundary. <br />For non-Sunshine Ordinance projects: <br />•Retain existing 1,000-foot <br />radius from the subject site <br />within the City boundary, and <br />•300-foot radius for property <br />owners and tenants outside <br />City boundary. <br />Language <br />Interpretation <br />Section 2-153(f) requires the applicant <br />to provide language interpretation <br />services only when they receive a <br />written request for such services. <br />•Require the applicant to <br />provide language <br />interpretation services for in- <br />person meeting attendees in <br />Spanish. <br />•Maintain a provision allowing <br />community members to <br />request interpretation services <br />during the community meeting <br />in languages other than <br />English and Spanish.
