Noticing requirements for non-Sunshine Ordinance projects’ public hearings <br />will remain at a 1,000-foot radius of the subject project within the City boundary (no <br />change), and a 300-foot radius outside the City boundary to be consistent with state law. <br />Retaining the existing 1,000-foot radius for non-Sunshine Ordinance projects’ public <br />hearings will minimize the impact of the amendments on smaller development projects that <br />require approval of a discretionary action, such as a conditional use permit or variance. <br />Public Hearing noticing requires that both property owners and tenants be notified, <br />whether commercial or residential, and whether inside or outside the City boundary. <br />ENVIRONMENTAL IMPACT <br />The City Council finds and determines that this ordinance is not subject to the California <br />Environmental Quality Act (CEQA). Pursuant to CEQA and the CEQA Guidelines, the <br />adoption of this Ordinance is exempt from CEQA review pursuant to sections <br />15061(b)(3) and 15061(b)(5) of the CEQA Guidelines because it will not result in a <br />direct or reasonably foreseeable indirect physical change in the environment, as there is <br />no possibility it will have a significant effect on the environment. As a result, <br />Environmental Review No. 2023-27 will be filed upon adoption of this ordinance. <br />FISCAL IMPACT <br />There is no fiscal impact associated with this action. <br />EXHIBIT <br />1.
