14 <br /> <br />B. Each Sworn employee covered by this MOU who is continuously and regularly <br />assigned to a schedule of work that requires that they actually work a minimum of <br />four and one-half (4 ½) hours between the hours of 5:00 P.M. and 7:00 A.M. will <br />be paid a shift differential at a rate set at five (5) salary rate ranges (approximately <br />2.5% of base pay). <br /> <br />5.3 Bilingual Pay. Qualified employees who meet the following criteria shall be paid a monthly <br />pay differential, above their base monthly salary step, as follows: <br /> <br />A. Assignment by the Police Chief or their designee to a position requiring bilingual <br />capability in both English and any other language and American Sign Language; <br />and <br /> <br />B. Certification by the Executive Director of Human Resources or designee as having <br />satisfactorily demonstrated the required level of fluency in the second language. <br />Effective January 1, 2022, employees must recertify for this pay every three years. <br />Employees who were receiving this pay as of January 1, 2022 must recertify by <br />January 1, 2025 to continue to receive this pay. <br /> <br />C. Sworn: Street Level Proficiency in Spanish. A Police Officer or Sergeant who <br />successfully demonstrates the required level of bilingual fluency as determined by <br />the Executive Director of Human Resources or designee shall be paid bilingual pay <br />of equal to the product obtained by multiplying the Step āEā base salary rate of <br />Police Officer by five (5) salary rate ranges (approximately 2.5% of base pay). <br /> <br />D. Sworn: Complex Level Proficiency in Designated Languages. A Police Officer or <br />Police Sergeant who successfully demonstrates the required level of bilingual <br />fluency as determined by the Executive Director of Human Resources or designee <br />shall be paid a bilingual pay equal to the product obtained by multiplying the Step <br />āEā base salary rate of Police Officer by ten (10) salary rate ranges (approximately <br />5% of base pay). <br /> <br />E. Non-Sworn: Secondary Level Proficiency in Designated Languages. A non-sworn <br />employee who successfully demonstrates the required level of bilingual fluency as <br />determined by the Executive Director of Human Resources or designee shall be <br />paid forty dollars ($40) per month. <br /> <br />F. Non-Sworn: Primary Level Proficiency in Designated Languages. Assigned <br />positions where it has been determined by the Police Chief that bilingual <br />proficiency is essential to carry out duties and responsibilities of a critical and/or <br />emergency nature without ready access to backup assistance, or positions where <br />bilingual public contact is a major, essential, or integral element of the work being <br />performed, will be designated as Primary Bilingual Assignments. A non-sworn <br />employee assigned to such a position who successfully demonstrates the required <br />level of bilingual fluency shall be paid one hundred seventy-five dollars ($175) per <br />month. <br />
