Rent Stabilization and Just Cause Eviction Ordinances <br />October 18, 2022 <br />Page 2 <br />3 <br />0 <br />1 <br />6 <br />c. Revise the Rental Housing Board appointment process wherein the seven <br />(7) Board Members shall be appointed by each City Councilmember, and <br />approved by the City Council, in an equitable order based upon a random <br />lottery process. <br />4. Reinstate the following exemption into the Ordinance: <br />a. “Housing restricted by deed, regulatory restriction contained in an <br />agreement with a government agency, or other recorded document as <br />affordable housing for persons and families of very low, low, or moderate <br />income, as defined in Section 50093 of the Health and Safety Code, or <br />subject to an agreement that provides housing subsidies for affordable <br />housing for persons and families of very low, low, or moderate income, as <br />defined in Section 50093 of the Health and Safety Code or comparable <br />federal statutes.” <br />5. Clarification Language: <br />a. Correct grammatical errors concerning the capitalization of “Tenant” and <br />other definitions throughout the Ordinance. <br />b. The Fair Return Petition, Capital Improvement Petition, and Tenant <br />Petition shall be available in the language that the Owner and Tenant <br />used to negotiate the terms of the Tenancy. <br />For ease of review, a redline version of the adopted Ordinance presented at the first <br />reading on October 4, 2022 is attached as Exhibit 1 reflecting these conforming <br />revisions. The clean version of the Ordinance is attached as Exhibit 2. <br />FISCAL IMPACT <br />There is no fiscal impact associated with this action. However, staff will return to City <br />Council at a later date upon any implementation of the Ordinance that will have a fiscal <br />impact with the goal of being cost neutral. <br />EXHIBIT(S) <br />1.
