REGULATORY COMPLIANCE <br />The Recipient agrees to comply or assist Reclamation with all regulatory compliance <br />requirements and all applicable state, Federal, and local environmental and cultural and <br />paleontological resource protection laws and regulations as applicable to this project. These may <br />include, but are not limited to, the National Environmental Policy Act (NEPA), including the <br />Council on Environmental Quality and Department of the Interior regulations implementing <br />NEPA, the Clean Water Act, the Endangered Species Act, consultation with potentially affected <br />Tribes, and consultation with the State Historic Preservation Office. If the Recipient begins <br />project activities that require environmental or other regulatory compliance approval prior to <br />receipt of written notice from a Reclamation GO that all such clearances have been obtained, <br />then Reclamation reserves the right to initiate remedies for non-compliance as defined by <br />2 CFR 200.340 up to and including unilateral termination of this agreement. <br />II. RECLAMATION STANDARD TERMS AND CONDITIONS <br />1. REGULATIONS <br />The regulations at 2 CFR Subtitle A, Chapter II, Part 200 "Uniform Administrative <br />Requirements, Cost Principles, and Audit Requirements for Federal Awards", are hereby <br />incorporated by reference as though set forth in full text. Failure of a Recipient to comply with <br />any applicable regulation or circular may be the basis for withholding payments for proper <br />charges made by the Recipient and/or for termination of support. <br />2. PAYMENT <br />2.1 Payment (2 CFR 200.305). <br />(a) For states, payments are governed by Treasury -State Cash Management Improvement Act <br />(CMIA) agreements and default procedures codified at 31 CFR part 205 and Treasury Financial <br />Manual (TFM) 4A-2000, "Overall Disbursing Rules for All Federal Agencies". <br />(b) For non -Federal entities other than states, payments methods must minimize the time <br />elapsing between the transfer of funds from the United States Treasury or the pass -through entity <br />and the disbursement by the non -Federal entity whether the payment is made by electronic funds <br />transfer, or issuance or redemption of checks, warrants, or payment by other means. See also <br />§200.302(b)(6).
