<br />City will reimburse MWDOC for any activity and the City is also responsible for seeking and <br />securing reimbursement directly from Metropolitan. Specific terms and conditions will be <br />provided by MWDOC to the City in the annual WLC Exhibits or Amended WLC Exhibits. <br />3.1.6. MWDOC shall invoice the City on a monthly basis for WLC Shared Services and <br />Technical Assistance work completed. <br />4. MWDOC K-12 Water Education Programs ("Choice School Programs") <br />4.1. Choice School Programs. The Parties agree that the Choice, or pay-for-service, School Program <br />offerings will be made available in the City's water service area for the Term of this Agreement, <br />without the need for a separate agreement between the Parties in addition to this Agreement. The <br />City sponsors program offerings within its service area at no cost to the schools or students by <br />opting-in. The City will have no obligations to participate in any Choice School Program unless <br />the City has agreed in writing to participate through the annual Choice School Programs <br />Commitment Form. <br />There are multiple Choice School Program options: (a) a program for students in Kindergarten <br />through Second Grade ("K-2 Choice Elementary School Program"); (b) a program for students in <br />Third Grade through Fifth Grade (“3-5 Choice Elementary School Program”); (c) a program for <br />students in Sixth Grade through Eighth Grade (“Choice Middle School Program”); and (d) a <br />program for students in Ninth Grade through Twelfth Grade ("Choice High School Program"). <br />Program offerings include options for in-person and live virtual lessons presented by trained <br />education specialists. The school approved to receive any Choice School Program will determine <br />whether the program can be delivered in-person or virtually. <br />Before the start of each school year and the commencement of any Choice School Program <br />during the Term, MWDOC will provide the City with a detailed description of the program <br />offerings and a complete price breakdown for each. The program description provided to the City <br />will include budget recommendations and expected commitments and require written consent by <br />the City before implementation. The City may request minor adjustments during the course of the <br />program, and the City will not incur additional costs without the City’s prior written consent. <br />4.2. Annually, the City will set Choice School Program commitments. MWDOC and its contractors <br />will attempt to fulfill the commitment amounts. However, there is no guarantee as to the number <br />of schools and students that will participate in the Choice School Programs. MWDOC will invoice <br />the City for the total annual estimated costs. MWDOC will provide a reconciliation at year-end <br />based on the actual services provided. The City will be responsible for paying MWDOC the <br />difference if the estimate is lower than the actual costs and MWDOC will reimburse the City the <br />difference if the estimate is higher than the actual costs. <br />4.3. Choice School Program Invoices. MWDOC will submit invoices to the City in January and July <br />each year for the services provided in accordance with the Agreement.
