Public Works Agency <br />www.santa-ana.org/pw <br />Item # 19 <br />City of Santa Ana <br />20 Civic Center Plaza, Santa Ana, CA 92701 <br />Staff Report <br />March 1, 2022 <br />TOPIC: Notification of Intent to Comply with California Senate Bill 1383 <br />AGENDA TITLE <br />Resolution Authorizing Execution of Notification of Intent to Comply with California Senate <br />Bill 1383 Organic Waste Recycling Regulations <br />RECOMMENDED ACTION <br />Adopt a resolution authorizing the City of Santa Ana to submit to CalRecycle a Notification <br />of Intent to Comply with California Senate Bill 1383 Organic Waste Recycling <br />Regulations. <br />DISCUSSION <br />In September 2016, Governor Jerry Brown signed Senate Bill (SB) 1383 into law, setting <br />statewide methane reduction targets. The targets include requirements to reduce organic <br />waste sent to landfills, such as food waste, paper products, and green waste, by 75 <br />percent, and rescue 20 percent of edible food by 2025. <br />To achieve this goal, SB 1383 requires cities to implement the following actions by <br />January 1, 2022: adopt a mandatory recycling ordinance; provide new organics recycling <br />services to all residential, multi-family properties, and commercial businesses; develop <br />an edible food recovery program; purchase organic materials and recycled content paper <br />products; require franchise solid waste services provider to comply with SB 1383 through <br />the City franchise agreement; and establish compliance, enforcement, education, and <br />reporting programs. <br />In recognition of the challenges facing local jurisdictions due to the COVID-19 pandemic, <br />Governor Newsom signed SB 619 into law in October 2021. This bill allows local <br />jurisdictions to submit a Notification of Intent to Comply (NOIC) to CalRecycle for relief <br />from civil penalties for calendar year 2022. The NOIC describes the SB 1383 regulatory <br />items that are delayed, includes a schedule for completing the remaining actions, and <br />contains justification supporting the updated timeline. Requests for approval of an NOIC <br />must include an approved City Council resolution (Exhibit 1).
