2. Second priority shall be given to persons who are either: <br /> <br />a. Residents of Santa Ana and/or <br /> <br />b. Working in Santa Ana at least 32 hours per week for at <br />least the last 6 months. <br /> <br />(6) Affirmative Marketing. Prior to the issuance of a Certificate of <br />Occupancy, Developer shall prepare and obtain Agency’s approval of an <br />affirmative marketing program for leasing the affordable units at the <br />Project. <br /> <br />(7) Crime Free Housing. Developer shall work with Agency staff to develop <br />a crime free housing policy, procedure, and design plan. <br /> <br />(8) Onsite Parking Management Plan. Developer shall provide onsite parking <br />for residents and visitors of the Project and actively monitor the parking <br />demand of the Project site. Developer shall continually monitor and take <br />appropriate measures to manage the parking demand of the Project site to <br />mitigate the use of offsite parking spaces on private or public properties <br />and/or right-of-way. Developer has submitted a Parking Management <br />Plan (the “PMP”) dated March 10, 2020, outlining appropriate measures to <br />manage and mitigate the use of offsite parking spaces and/or right of way. <br />Prior to issuance of a Certificate of Occupancy, Developer shall obtain <br />approval from the Agency for said plan. Notwithstanding the foregoing, <br />in no event may the plan or the requirements of this subsection supersede <br />the parking allowed under the Density Bonus Agreement or be interpreted <br />in a manner requiring parking in excess of twelve (12) onsite parking <br />spaces, ten (10) of which shall be tandem parking spaces. <br /> <br /> <br /> <br />C. Cure Period. If at any time the Agency determines that the Restricted Units are <br />not being managed or maintained in accordance with the approved Management Plan, Agency <br />shall provide Developer with written notice thereof which notice shall include a reasonable cure <br />period not less than thirty (30) days. If the deficiencies are not cured within the cure period <br />provided in the Agency notice, Developer shall change the management agent or the practices <br />complained of, upon receipt of written notice from the City Project Manager. The City Project <br />Manager may require Developer to change management practices or to terminate the <br />management contract and designate and retain a different management agent. The management <br />agreement shall provide that it is subject to termination by Developer without penalty, upon <br />thirty (30) days prior written notice, at the direction of the City Project Manager. Within ten (10) <br />days following a direction of the City Project Manager to replace the management agentthe <br />Developer shall select another management agent or make other arrangements satisfactory to the <br />City Project Manager or designee for continuing management of the Restricted Units. <br /> <br />EXHIBIT 4
