The City <br />shall direct the Trustee prior to 12:00 p.m. Pacific time on the last Business Day before the date on <br />which a Permitted Investment matures or is redeemed as to the reinvestment of the proceeds thereof. <br />In the absence of such direction, the Trustee shall invest in investments authorized under clause (8) <br />contained in the definition of “Permitted Investments.” The Trustee may rely on the City’s <br />certification in such investment instructions that such investments are permitted by law and by any <br />policy guidelines promulgated by the City. Money held in any fund or account hereunder may be <br />commingled for purposes of investment only. <br />The Trustee may, with the prior written approval of an Authorized City Representative, <br />purchase from or sell to itself or any affiliate, as principal or agent, investments authorized by this <br />Section 9.01. Any investments and reinvestments shall be made after giving full consideration to the <br />time at which funds are required to be available hereunder and to the highest yield practicably <br />obtainable giving due regard to the safety of such funds and the date upon which such funds will be <br />required for the uses and purposes required by this Trust Agreement. The Trustee or any of its <br />affiliates may act as agent in the making or disposing of any investment and may act as sponsor or <br />advisor with respect to any Permitted Investment. For investment purposes, the Trustee may <br />commingle the funds and accounts established hereunder, but shall account for each separately. <br />The City acknowledges that to the extent regulations of the Comptroller of the Currency or <br />other applicable regulatory entity grant the City the right to receive brokerage confirmations of <br />security transactions as they occur, the City specifically waives receipt of such confirmations to the <br />extent permitted by law. The Trustee will furnish the City with periodic cash transaction statements <br />which shall include details for all investment transactions made by the Trustee hereunder. <br />Section 9.02 Reports. The Trustee shall furnish at least quarterly to the City a report <br />(which may be in the form of the Trustee’s regular account statements) of all investments made by <br />the Trustee and of all amounts on deposit in each fund and account maintained hereunder. <br />Section 9.03 Valuation and Disposition of Investments. For the purpose of determining <br />the amount in any fund or account hereunder, all Permitted Investments shall be valued at the market <br />value thereof not later than July 1 of each year. With the prior written approval of an Authorized <br />City Representative, the Trustee may sell at the best price obtainable, or present for redemption, any <br />Permitted Investment so purchased by the Trustee whenever it shall be necessary in order to provide <br />money to meet any required payment, transfer, withdrawal or disbursement from any fund or account <br />hereunder, and the Trustee shall not be liable or responsible for any loss resulting from such <br />investment or sale, except any loss resulting from its own negligence or willful misconduct. <br />Section 9.04 Application of Investment Earnings. Investments in any Fund or Account <br />shall be deemed at all times to be a part of such Fund or Account, and any profit realized from such <br />investment shall be credited to such Fund or Account and any loss resulting from such investment <br />shall be charged to such Fund or Account. Interest earnings on investments in any Fund or Account <br />shall be deposited in the Bond Interest Account of the Revenue Fund.
