Consider Whether to Adopt Resolutions Calling a General Municipal Election for <br />November 5, 2024, Requesting Consolidation with the Statewide General Election, <br />and Placing Ballot Measures Before the Voters Asking Whether to 1) Adopt a Rent <br />Stabilization and Just Cause Eviction Ordinance and 2) Whether to Permit Noncitizen <br />Voting in Municipal Elections <br />Department(s): City Attorney Office <br />Recommended Action: Consider the following options: <br />1. Take no action; <br />2. Adopt a resolution calling and giving notice of a General Municipal Election to <br />be held in the City of Santa Ana on November 5, 2024 for the submission of a <br />ballot measure to the qualified voters proposing a Rent Stabilization and Just <br />Cause Eviction Ordinance and requesting the Orange County Board of <br />Supervisors to consolidate this election with the Statewide General Election. <br />RESOLUTION NO. 2023-XXX — A RESOLUTION OF THE CITY COUNCIL OF <br />THE CITY OF SANTA ANA CALLING AND GIVING NOTICE OF A GENERAL <br />MUNICIPAL ELECTION TO BE HELD IN THE CITY OF SANTA ANA ON <br />NOVEMBER 5, 2024 FOR THE SUBMISSION OF A BALLOT MEASURE TO <br />THE QUALIFIED VOTERS PROPOSING A RENT STABILIZATION AN JUST <br />CAUSE EVICTION ORDINANCE AND REQUESTING THE ORANGE <br />COUNTY BOARD OF SUPERVISORS TO CONSOLIDATE THIS ELECTION <br />WITH THE STATEWIDE GENERAL ELECTION (includes determination that <br />this Resolution is not subject to the California Environmental Quality Act <br />(CEQA) pursuant to sections 15060(c)(2) and 15060(c)(3) of the State CEQA <br />Guidelines because it will not result in a direct or reasonably foreseeable <br />indirect physical change in the environment, as there is no possibility it will <br />have a significant effect on the environment and it is not a "project," as defined <br />in section 15378 of the State CEQA Guidelines. Furthermore, the Resolution <br />falls within the "common sense" CEQA exemption set forth in CEQA Guidelines <br />section 15061(b)(3), excluding projects where "it can be seen with certainty <br />that there is no possibility that the activity in question may have a significant <br />effect on the environment."); <br />/_10119061 V <br />3.
