1.2. Association hereby declares as a burden upon Parcels <br />1 and 2 and for the benefit of Parcels 3 and 4 the following <br />reciprocal easements: <br />1.2.1. Non-exclusive easements for than purpose of <br />ingress to and egress from public streets or highways over that <br />portion of Parcels 1 and 2 designated for parking and driveway <br />purposes, excepting those portions which are designated as <br />Restricted Common Area. Such rights shall extend to normal <br />pedestrian and vehicular access but shall exclude any vehicle <br />having a weight, load distribution or wheel type that would not <br />be permitted by applicable laws or regulations upon the adjoining <br />public streets. <br />1.2.2. Aron -exclusive easements for vehicular parking <br />on those portions of Parcels 1 and 2 designated for parking, <br />except those portions designated as '-testricted common Area, and <br />subject to reasonable regulations and all vehicle code <br />regulations of any appropriate governmental authorities. <br />2. NASNTENANCE. The obligation for maintenance of the parking <br />and driveway areas located on each of Parcels 1 and 2 and Parcels <br />3 and 4 shall be assumed by the respective owners of the Parcels <br />in question. For purposes of this Agreement, CCHP and <br />Association shall each have the obligation to keep their <br />respective portions of the Parcels in a good and clean condition, <br />including, without limitation, the regular carrying out of <br />customary maintenance and repair of the paved surface thereon, <br />cleaning and removal of refuse and trash and maintenance of <br />appropriate striping or other designation of parking spaces. <br />Notwithstanding the foregoing, any damage to a portion of the <br />parking area of either owner's property resulting From violation <br />of the use limitation set forth herein, or any other willful or <br />negligent act or failure to act by party required to do so, shall <br />-3- <br />ORANGE,CA DOCUMENT: AG 1986.284222 Page 3 of 11 <br />Printed on 4/23/2008 8:59:48 AM Provided by DataTrace System <br />
