Authorize the City Manager to execute a takeover agreement with Great <br />American Insurance Group subject to change orders (not to exceed 25% of the <br />base bid amount) in accordance with the Greenbook: Standard Specifications for <br />Public Works construction, to take over the Santa Ana Zoo Giant River Otter and <br />Primate Trails Project and be responsible for the completion of all work in <br />accordance with the contract (Agreement No. A-2024-XXX). <br />2. Authorize the City Manager to execute a first amendment to the agreement with <br />CLR Design Inc. for construction support services for the Santa Ana Zoo Giant <br />River Otter and Primate Trails Project, to increase the amount by $75,000, for a <br />total agreement amount of $193,000 (Agreement No. A-2024-XXX). <br />GOVERNMENT CODE §84308 APPLIES: Yes <br />DISCUSSION <br />On November 2, 2021, the City Council awarded a contract to HYM Engineering <br />(Exhibit 1), the lowest responsible bidder, in accordance with the base bid in the amount <br />of $5,289,238, for construction of the Santa Ana Zoo Giant River Otter and Primate <br />Trails Exhibit, which is located in the heart of the Santa Ana Zoo. (Exhibit 2). <br />On April 20, 2021, the City Council awarded an agreement with CLR Design, Inc. for <br />Bidding and Construction Administration. This agreement was then extended on April 3, <br />2023 (Exhibit 3). HYM Engineering (Contractor) met all inspection and testing <br />requirements to complete approximately 60% of the contract scope of work but due to <br />issues unrelated to the project, the Contractor defaulted on the contract.
