Force Maieure: Neither the State Library nor the Grantee, its contractors, vendors, <br />or subcontractors, if any, shall be responsible hereunder for any delay, default, or <br />nonperformance of this Agreement, to the extent that such delay, default, or <br />nonperformance is caused by an act of God, weather, accident, labor strike, <br />fire, explosion, riot, war, rebellion, sabotage, flood, or other contingencies <br />unforeseen by the State Library or the Grantee, its contractors, vendors, or <br />subcontractors, and beyond the reasonable control of such party. <br />24. Forfeit of Grant Funds and Repayment of Funds Improperly Expended: If grant <br />funds are not expended, or have not been expended, in accordance with this <br />Agreement, the State Librarian or designee, at his or her sole discretion, may <br />take appropriate action under this Agreement, at law or in equity, including <br />requiring the Grantee to forfeit the unexpended portion of the grant funds, <br />including, but not limited to, the ten percent (10%) withhold, and/or to repay to <br />the State Library any funds improperly expended. <br />25. Fringe Benefit Ineligibility: Grantee agrees that neither the Grantee nor its <br />employees and contract personnel are eligible to participate in any employee <br />pension, health benefit, vacation pay, sick pay or other fringe benefit plan of the <br />State of California or the State Library. <br />26. Generally Accepted Accounfina Principles: The Grantee is required to use <br />Generally Accepted Accounting Principles in documenting all grant <br />expenditures. <br />27. Grant Monitor: The Grant Monitor's responsibilities include monitoring grant <br />progress and reviewing and approving Grant Payment Requests and other <br />documents delivered to the State Library pursuant to this Agreement. The Grant <br />Monitor may monitor Grantee performance to ensure Grantee expends grant <br />funds appropriately and in a manner consistent with the terms and conditions <br />contained herein. The Grant Monitor does not have the authority to approve any <br />deviation from or revision to the Terms and Conditions (Exhibit A and B) or the <br />Procedures and Requirements unless such authority is expressly stated in the <br />Procedures and Requirements. <br />28. Grantee: The government or legal entity to which a grant is awarded and which <br />is accountable to the State Library for the use of the funds provided. <br />a. The grantee will make reports to the State Librarian in such form and <br />containing such information as may be required to ensure the proper <br />used of funds consistent with the grantee's application, and award <br />agreement and accompanying documentation submitted.
