2. CITY agrees to pay, and CONSULTANT agrees to accept <br />for said services, a not to exceed fee of $319,000 for the scope <br />of work specified in their Proposal. CONSULTANT shall be paid <br />for services actually rendered. <br /> <br /> Any additional services performed by the consultant outside <br />of the original scope of work must be authorized in writing by <br />the CITY prior to commencing such work. In no case shall any <br />additional services exceed $32,000 for a maximum contract amount <br />of $351,000. <br /> <br /> The time of completion for the design portion of <br />consultant's work shall be 12 months from the date of this <br />contract. That portion of Consultant's work relating to <br />construction support services shall be completed in conjunction <br />with the actual construction schedule, which will be determined <br />once the design is complete and a construction contract has been <br />awarded. <br /> <br /> CONSULTANT shall periodically submit a detailed invoice <br /> showing services performed. Payment by CITY shall be within <br /> thirty (30) days following receipt of said invoice for work <br /> performed, subject to CITY accounting procedures. <br /> <br /> Notwithstanding the foregoing, payment need not be made for <br /> work which fails to meet the standard of performance specified <br /> in Section 4. <br /> <br /> 3. The CITY's Executive Director of the Public Works <br /> Agency, or his Designee, shall be the representative of the CITY <br /> <br /> <br />
