ORDINANCE NO. NS-128 AMENDING SECTION 2613 OF THE SANTA ANA MUNICI- <br /> PAL CODE PROVIDING FOR THE SALE OF RE~.L PROPERTY AND A~DING SECTION 2614 <br /> <br />THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: <br /> <br /> SECTION 1. That Section 2613 of the Santa Aha Municipal Code is hereby <br />amended to read as follows: <br /> <br /> "SECTION 2613. Sale of Real Property. <br /> <br /> Ail sales of City owned real property shall be made by the Council at a reg- <br /> ular Council meeting and shall be to the highest and best bidder. Sealed <br /> bids may be required or oral bids may be provided for. If sealed bids be <br /> required, after they are opened, any person present may submit an oral bid <br /> on the following conditions: The opening o~al bid must exceed the amount of <br /> the highest sealed bid by ten per cent on the first $5,000.00 and by five per <br /> cent of the amount of said highest sealed bid on amounts in excess of $5,000.00 <br /> and not more than $10,000.00. After an opening oral bid has been made, which <br /> com~lles with the above requirements, any person may raise said oral bid with- <br /> out regard for the above percentages, providing that the City Council shall <br /> disregard any bid which does not exceed the highest bid theretofore made by <br /> at least one per cent of such highest bid. The successful oral bidder must <br /> deliver to the Clerk of the Council at said meeting and immediately following <br /> the declaration of sale, a written statement of his bid signed by the bidder <br /> together with ten per cent of the amount of his bid in cash or by cashier's <br /> or certified check. Failure to deposit such written statement of bid or said <br /> ten per cent of the bid price may be considered a withdrawal of the bid and <br /> the Council may declare such withdrawal if it so desires. <br /> <br /> Upon the recommendation of the City Manager submitted in writing, the <br /> Council may determine that the property being offered for sale can have real <br /> value only to a certain owner or owners of adjoining property and could be <br /> used by other persons only for the purpose of nuisance value to such adjoin- <br /> ing or abutting land owners. In event they ma~e such determination, the same, <br /> with the reasons therefor, shall be entered in full on the Council Minutes. <br /> After such declaration has been made as next hereinabove provided for, the <br /> Council may, by direct negotiation, provide for the sale of the real property <br /> covered thereby, without co~liance with the auction or public sale require- <br /> ments in this Section provided for." <br /> <br /> <br />
