The Building Official shall not make any refund of fees <br />collected amounting to $2.00 or less. In case a refund is <br />made, the amount of such refund shall not be more than <br />80% of the amount of the fee paid nor shall such refund include <br />any part of the first $2.00 of such fee. No refund of such fee <br />or part thereof shall be made unless applied for within one <br />year from the date of the issuance of the permit. No fees or <br />portions of fees are refundable for Plan Checking Fees or for <br />House Moving Applications or mileage in conjunction therewith. <br />When fees are erroneously collected by duplication of permits <br />or for construction outside the jurisdiction of the City of <br />Santa Ana, 100% may be refunded. <br /> <br />SECTION 8105. Use or Occupancy. <br /> Section 306(a) is hereby amended to read as follows: <br /> <br /> Use or Occupancy. No building or structure shall be used <br /> or occupied, nor shall such building or structure be <br /> connected with permanent utility services, until the Building <br /> Official has determined compliance with this Code, all other <br /> applicable ordinances and laws, and conditions of the <br /> issuing of the building permit, and has authorized occupancy <br /> of such building or structure. <br /> <br />SECTION 8106. Grade. <br /> <br /> Section 408 is amended by changing Paragraph 4 to read as <br />follows: <br /> GRADE (Ground level) is the average finished ground level on <br /> a lot within 10 feet of a building - excluding filled areas. <br /> <br />SECTION 8107. Patio Structure. <br /> <br /> Section 417 is amended to add a new definition to read as <br />follows: <br /> PATIO STRUCTURE is an unenclosed roofed structure not <br /> exceeding 400 square feet in area nor 10 feet in height <br /> built in conjunction with Group I or J Occupancies. <br /> <br />SECTION 8108. Service Station Roofs. <br /> Section l102(b) is hereby amended by changing the first para- <br />graph and adding an exception to read as follows: <br /> <br /> (b) Special Provisions. Motor vehicle service stations, <br /> including canopies and supports over pumps, shall be <br /> incombustible or of one-hour fire-resistive construction. <br /> EXCEPTION: Roofs of One-story service stations may be of <br /> heavy-timber construction. <br /> <br />SECTION 8109. Storage Areas. <br /> Section l102(b) is hereby amended by adding an exception to <br />the third paragraph to read as follows: <br /> EXCEPTION: A One-Hour Fire-Resistive Occupancy Separation is <br /> not required where an approved automatic fire- <br /> extinguishing system is installed throughout the <br /> building. Area increases shall also be permitted <br /> as set forth in Section 506(c). <br /> <br />SECTION 8110. S~imminq Pools. <br /> Section 1501, second paragraph, is hereby amended to read as <br />follows: <br /> DIVISION 2.
