STREET shall mean any place commonly used for the <br />purpose of public travel. <br /> <br />TAXICAB shall mean a motor vehicle used in the busi- <br />ness of transportation of passengers for hire, where <br />transportation is not over a fixed and definite route, <br />but is under the control, as to destination and/or <br />route, of the passenger or passengers being carried <br />therein. <br /> <br />TAXICAB TERMINAL shall mean any office, station, <br />building, stand, substation or other place of business <br />of a duly authorized holder at which calls are receiv- <br />ed, or may be received, from prospective passengers <br />for hire, from which place of business the holder <br />directs the dispatch and return taxicabs used in the <br />taxicab service for which the Certificate of Public <br />Convenience and Necessity has been granted. <br /> <br />TAXIMETER shall mean any mechanical instrument, <br />applicance, device or machine by which the charge for <br />hire of a motor vehicle is mechanically calculated, <br />either for distance traveled or time consumed, or both, <br />and on said instrument, appliance, device or machine <br />such charge is indicated by figures. <br /> <br />TOP LIGHT shall mean an electrically operated sign <br />with lights of a color and design approved by the <br />Chief of Police. <br /> <br />TOTAL STOPPAGE shall mean the complete halting of <br />bus transportation service furnished within the <br />City of Santa Ana resulting from a labor strike or <br />a disaster. <br /> <br />WAITING TIME shall mean the time when the taxicab <br />is not in motion from the time of acceptance to the <br />time of discharge of a passenger, including any <br />time the taxicab is not in motion due to traffic <br />or the request, act or fault of the passenger. The <br />first three minutes elapsing prior to the arrival <br />of the passenger at the beginning of a trip shall <br />not be considered as waiting time, and in no ev~t <br />shall any time be considered as waiting time for <br />any period prior to the time of arrival designated <br />by the prospective passenger when requesting the <br />taxicab. <br /> <br />Section 38-2 - Certificate of Public Convenience and <br /> <br />Necessity Required. <br /> <br />No person shall engage in the business of operating <br />or permit to be operated any ambulance, motorbus or <br />taxicab owned or controlled by him, as a vehicle for <br />hire upon the streets of the City without first ob- <br />taining a Certificate of Public Convenience and <br />Necessity from the City Council and having affixed to <br />each vehicle a permit as required by Section 38-18 of <br />this Chapter and a device as required by Section 38-20a <br />of this Chapter. <br /> <br />-3- <br /> <br /> <br />
