ORDINANCE NO. NS-1222 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA PROVIDING FOR A SANITATION CHARGE UPON <br />THE USE OF SANITATION FACILITIES AND SERVICES AND <br />AMENDING CHAPTER 35 OF THE SANTA ANA MUNICIPAL CODE. <br /> <br /> THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS <br />FOLLOWS: <br /> <br /> SECTION 1: That the Santa Ana Municipal Code, is hereby amended <br />by adding an article to Chapter 35, Article VII, consisting of Sections <br />35-200 through 35-249, which said article reads as follows: <br /> <br />Sec. 35-200. Purpose <br /> <br /> The purpose of this article is to provide a revenue for the <br />general operation of the City and is not intended for regulation. <br /> <br />Sec. 35-201. Establishment of a Service Charge <br /> <br /> The City shall make a monthly service charge to each residen- <br />tial, commercial, industrial, manufacturing or other unit which is <br />located within any sewer district or district serviced by a public <br />sewer for the maintenance, construction or reconstruction of the <br />sewage collection system, street cleaning or any other general opera- <br />tion of the City. Such service charge shall be an amount equal to <br />the following schedule: <br /> <br /> 1. For each structure containing one through four dwelling <br />units, the sum of $.50 per month per dwelling unit. <br /> <br /> 2. For each structure containing five or more dwelling units, <br />the sum of ~.00 per month. <br /> <br /> 3. For each commercial, industrial and manufacturing unit, the <br />sum of $4.00 per month. <br /> <br /> 4. Those units located within the City of Santa Ana and pur- <br />chasing water from sources other than the City, shall be billed by <br />the City at the same rate as designated in paragraphs 1 through 3 <br />of this Section. <br /> <br />Sec. 35-202. Persons Obligated <br /> <br /> The customer of record or occupant of each place or premise shall <br />be liable for payment of all charges as set forth in this article. <br />Should the customer of record or occupant of any place or premise fail <br />to pay all such charges before the sum becomes delinquent, as provided <br />in Section 39-23 of the Santa Ana Municipal Code, then in either of <br />such events the property owner of record of such place or premise shall <br />be liable for the payment of all such charges. <br /> <br />Sec. 35-203. Payment of Sanitation Bills and Penalties <br /> <br /> (a) Date Payment Due: Sanitation bills, charges and penalties <br />are due and payable at the Department of Finance in the City Hall on <br />the date of billing and become delinquent fifteen (15) days after the <br />date of such billing. <br /> <br /> (b) Penalties: A penalty of ten percent (10%) shall be assessed <br />on all unpaid sanitation bills thirty (30) days after the billing date. <br />No penalty, however, will accrue until thirty (30) days after the date <br />that the statement has been deposited with the United States Postal <br />Service, properly addressed and prepaid postage affixed thereto. <br /> <br />-1- <br /> <br /> <br />
