ORDINANCE NO. NS-1228 <br />PAGE TWO <br /> <br />(c) All pedestrian <br /> for the use of <br /> public. <br /> <br />walks, malls and open areas <br />occupants and members of the <br /> <br />(d) Location and height of all walls, fences and <br /> screen planting. <br /> <br />(e) Types of surfacing, such as paving, turfing <br /> or gravel to be used at the various locations. <br /> <br />(4) Plans and elevations of structures to indicate <br /> architectural type and construction standards, <br /> <br />(5) <br /> <br />If the applicant proposed to provide open areas <br />and recreational facilities to be used by the occu- <br />pants of two (2) or more dwelling units, he shall <br />so state in his application and the application <br />shall include a plan, acceptable to the city, for <br />the preservation and maintenance of the common <br />elements of the property, until said project is <br />terminated by either the planning commission, <br />city council, or both. <br /> <br />(6) <br /> <br />Such other information as may be required by <br />the planning department to assist in the consid- <br />eration of the proposed development. <br /> <br />(C) Procedure. The applicant for approval of a planned <br /> residential development shall be the owner, all of the <br /> owners of the site acting jointly, or an authorized <br /> agent. <br /> Each prospective applicant is to confer with the plan- <br /> ing department in connection with the preparation of <br /> a planned residential development prior to the sub- <br /> mission of the conditional use permit application to <br /> the planning commission. The chief purpose of such <br /> a pre-application conference is to benefit the prospec- <br /> tive applicant by providing information and clarifi- <br /> cation of requirements before such prospective appli- <br /> cant incurs any substantial expense in the preparation <br /> of plans. <br /> <br /> SECTION 2: If any section, subsection, sentence, <br />clause, phrase or portion of this ordinance is for any <br />reason held to be invalid or unconstitutional by the deci- <br />sion of any court of competent jurisdiction, such decision <br />shall not affect the validity of the remaining portions of <br />this ordinance. The City Council of the City of Santa Ana <br />hereby declares that it would have adopted this ordinance <br />and each section, subsection, sentence, clause, phrase or <br />portion thereof irrespective of the fact that any one or <br />more sections, subsections, clauses, phrases or portions be <br />declared invalid or unconstitutional. <br /> <br /> SECTION 3: Neither the adoption of this ordinance nor <br />the repeal hereby of any ordinance shall in any manner affect <br />the prosecution for violation of ordinances, which violations <br />were committed prior to the effective date hereof, nor be <br />construed as affecting any of the provisions of such ordi- <br />nances relating to the collection of any such license or <br />penalty or the penal provisions applicable to any violation <br />thereof, nor to affect the validity of any bond or case de- <br />posit in lieu thereof, required to be posted, filed or depo- <br />sited pursuant to any ordinance, and all rights and obliga- <br />tions thereunder appertaining shall continue in full force <br />,nd effect. <br /> <br /> <br />
