ORDINANCE NO. NS-1413 <br />PAGE THREE <br /> <br /> SECTION 8: That the Santa Ana Municipal Code, is <br />hereby amended by adding a section to be numbered 8-163, <br />which said section reads as follows: <br /> <br /> Sec. 8-163. Type of lock or latch (Section 3303(c)). <br /> <br /> Section 3303(c) of the Building Code is amended by <br />amending the exception set forth therein to read as follows: <br /> <br />EXCEPTION: This requirement shall not apply to ex- <br />terior exit doors in a Group B Occupancy if there is a <br />readily visible, durable sign on or adjacent to the <br />door, stating "THIS DOOR TO REMAIN UNLOCKED DURING <br />BUSINESS HOURS." The sign shall be in letters not less <br />than 1 inch high on a contrasting background. Except <br />for office suites housing one tenant, the locking <br />device must be of a type that will be readily dis- <br />tinguishable as locked. The use of this Exception may <br />be revoked by the Building Official for due cause. <br /> <br /> SECTION 9: That the Santa Aha Municipal Code, is <br />hereby amended by adding a section, to be numbered 8-179, <br />which said section reads as follows: <br /> <br />Sec. 8-179. Agricultural buildings (Appendix Chapter <br />15) <br /> <br />The Uniform Building Code is amended by deleting the <br />provisions pertaining to Chapter 15 in the Appendix <br />thereof, including Table No. 15-A, therein. <br /> <br /> SECTION 10: If any section, subsection, sentence, <br />clause, phrase or portion of this ordinance is for any <br />reason held to be invalid or unconstitutional by the de- <br />cision of any court of competent jurisdiction, such decision <br />shall not affect the validity of the remaining portions of <br />this ordinance. The City Council of the City of Santa Aha <br />hereby declares that it would have adopted this ordinance <br />and each section, subsection, sentence, clause, phrase or <br />portion thereof irrespective of the fact that any one or <br />more sections, subsections, sentences, clauses, phrases or <br />portions be declared invalid or unconstitutional. <br /> <br /> 'SECTION 11: Neither the adoption of this ordinance nor <br />the rePeal hereby of any ordinance shall in any manner <br />affect the prosecution for violation of ordinances, which <br />violations were committed prior to the effective date hereof, <br />nor be construed as affecting any of the provisions of such <br />ordinance relating to the collection of any such license or <br />penalty or the penal provision applicable to any violation <br />thereof, nor to affect the validity of any bond or cash <br />deposit in lieu thereof, required to be posted, filed or <br />deposited pursuant to any ordinance and all rights and <br />obligations thereunder appertaining shall continue in full <br />force and effect. <br /> <br /> SECTION 12: The modification to section 1413 of the <br />Uniform Building Code is hereby found to be reasonably <br />necessary because of local conditions for the reason that <br />smoke detectors have been found to be extremely effective in <br />saving lives in residential occupancies in the City of Santa <br />Aha, such that it is reasonable to require an owner of an <br />existing residential building to incur the relatively minor <br />expense of installation of such smoke detectors when such <br />owner proposes to make a substantial improvement to his <br />property. It is further found that this modification has <br />been approved for inclusion in the next edition of the <br />Uniform Building Code. <br /> <br />-3- <br /> <br /> <br />
