N$-1548 <br />PAGE THREE <br /> <br />(1) Dividing the aggregate dwelling unit <br />assessment by the total number of persons <br />residing in the project, to obtain a per <br />capita share; <br /> <br />(2) Multiplying such per capita share by <br />the number of persons residing in the <br />dwelling unit. <br /> <br /> SECTION 3: That Section 34-317 of the Santa <br />Ana Municipal Code, is hereby amended to read as follows: <br /> <br />Sec. 34-317. Declaration of covenants, <br /> conditions and restrictions. <br /> <br /> No tentative map shall be approved except upon the <br />condition that a declaration of covenants, conditions, and <br />restrictions be approved by the planning director and the <br />city attorney prior to the approval of the final map, <br />providing for the following: <br /> <br />a) <br /> <br />Perpetual maintenance by the associated <br />owners, in good, ~anitary and attractive <br />conditions of all common areas and improve- <br />ments, including landscaped areas, walls, <br />driveways, parking areas, trash areas and <br />buildings, in accordance with plans and <br />documents on file in the office of the <br />clerk of the council of the City of Santa <br />Ana. <br /> <br />b) <br /> <br />Prohibition of the parking or storage of <br />trailers, boats and recreational vehicles, <br />except in such area reserved for the <br />storage thereof as may be provided in the <br />plans and documents on file with the clerk. <br /> <br />c) <br /> <br />Provision for a system whereby the <br />homeowner's association shall make <br />assessments for municipal water billings <br />among the owners of dwelling units in <br />the manner prescribed by section 34-313.5, <br />including: <br /> <br />(1) A statement that the homeowners' <br />association is liable to the City of Santa <br />Ana for payment of the municipal water <br />billings and attendant fees, and that <br />collection of water assessments on indiv- <br />idual unit owners is solely the <br />responsibility of the homeowners' <br />association; <br /> <br />(2) A method by which the number of <br />persons residing in each dwelling unit <br />shall be determined; and <br /> <br />(3) Provision for continuous maintenance <br />of meters, if any, owned by the associated <br />owners in common; <br /> <br /> <br />
