ORDINANCE NO. NS-1598 <br />Page Four <br /> <br />SECTION 3: That the Santa Ana Municipal Code is hereby <br />amended by adding a section, to be numbered 8-2004.5, which <br />said section reads as follows: <br /> <br /> SECTION 8-2004.5. <br />OWNERS <br /> <br />EXTENSIONS BY ADJOINING BUILDING <br /> <br /> (a) APPLICATION. The owners of two (2) or more buildings <br />which are subject to the provisions of this article, which <br />buildings are under separate ownership, located on adjoining <br />or abutting lots and are physically contiguous and inter- <br />connected with each other, may jointly apply to the director <br />for an extension of the time limits specified in subsection <br />(b) of Section 8-2004 of this article. Such joint application <br />for an extension may be filed even though each of the build- <br />ings included within the application have been placed in <br />different rating classifications by the director pursuant to <br />subsection (a) of Section 8-2004 of this article. No building <br />may be included within any such joint application, and no <br />such application shall be considered by the director, if <br />more than one hundred and eighty (180) days have elapsed <br />between the date the director mailed or served the initial <br />order or notice on the owner of any such building and the <br />date on which the joint application is filed. Said application <br />for an extension shall be accompanied by a written statement <br />indicating the name and address of the engineer and/or <br />architect engaged or retained by the building owners filing <br />the application, the plan of action contemplated by the <br />applicants in terms of conforming each of the buildings to <br />the requirements of this article, the accomplishments towards <br />the same as of the date the application is filed, and an <br />estimate of the time required to complete the formulation of <br />the proposed plan of action. <br /> <br /> (b) ACTION BY DIRECTOR. The director shall have sixty <br />(60) days from the date the application is filed in which to <br />either approve or disapprove the application, unless the <br />applicants agree to extend said time period. If the applicants <br />meet the requirements stated in subsection (a) of this <br />section, and if the director determines that the purposes of <br />this article would be served if said application were approved, <br />then the director may approve the application for an extension; <br />otherwise, the director shall deny the same. In approving <br />an application, the director shall have the authority to <br />modify any or all of the time limits set forth in subsection (b) <br />of Section 8-2004 of this article for achieving compliance <br />with the provisions of this article; provided, however, that <br />if two or more of the buildings included within the application <br />have been placed in different rating classifications by the <br />director, the extension granted by the director shall be <br />based on an average of the maximum time limits specified in <br />subsection (b) of Section 8-2004 in which to bring each such <br />building into conformance with this article but in no event <br />shall any such extension be less than for a period of six <br />(6) months from the date the application is filed. <br /> <br /> No application for an extension shall be granted <br />unless the building owners who have submitted the application <br />have executed and submitted to the director an agreement <br />between themselves whereby each owner agrees, inter alia, to <br />bring the building owned by such owner into compliance with <br />the provisions of this article within the revised time <br />limits specified by the director. Such agreement shall be <br />subject to the approval of the city attorney. Failure of <br />the property owners filing the joint application for an <br />extension to execute and submit said agreement to the director <br />within sixty (60) days after the application is filed shall <br /> <br /> <br />
