ORDINANCE NO. NS- 1633 <br />PAGE TWO <br /> <br />and 2 and Group R, Division 1 Occupancies which are not more <br />than two stories in height and have not more than 6000 <br />square feet of projected roof area and there is a minimum of <br />10 feet from the extremity of the roof to the property lines <br />on all sides except for street fronts. <br /> <br />Skylights shall be constructed as required in Chapter 34. <br /> <br />Penthouses shall be constructed as required in Chapter 36. <br /> <br />For use of plastics in roofs, see Chapter 52. <br /> <br />For Attics; Access and Area, see Section 3205. <br />Roof Drainage, see Section 3207. <br /> <br />For <br /> <br /> SECTION 2: Pursuant to the provisions and authority of <br />Sections 17958.5 and 17958.7 of the Health and Safety Code <br />of the State of California, the City Council of the City of <br />Santa Ana finds, determines and declares that the above- <br />described amendment to Section 1704 of the Uniform Building <br />Code, 1979 Edition, is reasonably necessary for the health, <br />safety and general welfare of the residents of the City of <br />Santa Ana due to the following climatic, geographical and <br />topographical conditions: <br /> <br /> 1. The City of Santa Ana is geographically <br />located in an area which is subject to periodic extremely <br />high velocity wind conditions; said condition being further <br />accentuated by the topographical features of the hill and <br />canyon areas located easterly of the city; <br /> <br /> 2. The City of Santa Ana is subject to seasonably <br />high temperatures and dry atmospheric conditions which often <br />occur during times of the high velocity winds as hereinabove <br />described; and <br /> <br /> 3. Due to the climatic, geographical and topo- <br />graphical conditions hereinabove described, the City of <br />Santa Ana is susceptible to fires which are of particular <br />danger during periods of high winds when fires tend to <br />spread across building roofs where such roofs are not made <br />of noncombustible or fire-retardant construction. <br /> <br /> SECTION 3: That the City's Director of Planning and <br />Development Services be directed to file a copy of this <br />ordinance with the Department of Housing and Community <br />Development of the State of California. <br /> <br /> SECTION 4: If any section, subsection, sentence, <br />clause, phrase or portion of this ordinance is for any <br />reason held to be invalid or unconstitutional by the de- <br />cision of any court of competent jurisdiction, such decision <br />shall not affect the validity of the remaining portions of <br />this ordinance. The City Council of the City of Santa Ana <br />hereby declares that it would have adopted this ordinance <br />and each section, subsection, sentence, clause, phrase or <br />portion thereof irrespective of the fact that any one or <br />more sections, subsections, sentences, clauses, phrases or <br />portions be declared invalid or unconstitutional. <br /> <br /> SECTION 5: Neither the adoption of this ordinance nor <br />the repeal hereby of any ordinance shall in any manner <br />affect the prosecution for violation of ordinances, which <br />violations were committed prior to the effective date hereof, <br /> <br /> <br />
