ORDINANCE NO. NS- 1674 <br />PAGE SIX <br /> <br />(n) <br /> <br />The site in question for a planned res- <br />idential development must be large enough to <br />effectively carry out the intent and purposes <br />of the planned residential development as <br />stated in this division. <br /> <br />(o) <br /> <br />When a planned residential development is <br />to be divided for sale, lease or financing <br />through the subdivision of said development, <br />the provisions of Chapter 34-57(1), <br />Subdivisions, may be waived. A letter re- <br />questing waiver of the requirements of <br />Chapter 34-57(1) shall accompany the condi- <br />tional use permit application and shall <br />include a statement or supporting reason for <br />said waiver request. Said waiver may only be <br />granted in conjunction with the approval of <br />the conditional use permit being applied for. <br /> <br />SECTION 4: .That the Santa Ana Municipal Code is amended <br />by adding a section, to be numbered 41-613.2, which said <br />section reads as follows: <br /> <br />Sec. 41-613.2. Prohibition against use of required <br /> parking spaces for other purposes. <br /> <br />(a) <br /> <br />No person shall use, or allow the use of, any <br />parking space or area which is designed for the <br />parking of vehicles, and which is necessary to <br />provide a number of parking spaces in full or <br />partial satisfaction of the offstreet parking <br />requirements of this chapter, for any purpose <br />which prevents the use of such parking space <br />or area for the parking of vehicles on a <br />regular basis. <br /> <br />(b) <br /> <br />The use of a parking space which is required <br />to be provided for an automobile repair shop, <br />body shop or automobile service shop by this <br />chapter, for work on any automobile, or for <br />the storage of any automobile for more than <br />72 hours, or for the storage of equipment, <br />shall be deemed to be use for a purpose which <br />prevents the use of such parking space for the <br />parking of vehicles on a regular basis, within <br />the meaning of subsection (a) of this section. <br /> <br /> <br />
