ORDINANCE NO. NS-1755 <br />PAGE TWO <br /> <br /> (1) The dish antenna shall not be located <br />on any yard or building area which is viewable from any street <br />(including freeways but excluding alleys). <br /> <br /> (2) The dish antenna shall be screened from <br />view from surrounding property by fencing or landscaping. <br /> <br /> (3) The area occupied by a dish antenna <br />shall not be considered as open space, and no dish antenna <br />shall be installed which would cause the property to become <br />nonconforming to any open space requirement of this chapter. <br /> <br /> (c) On property which is neither located in a <br />residential zone nor used for residential purposes, a dish <br />antenna must be screened from view from any street (includ- <br />ing freeways but excluding alley~within 1000 feet of the <br />antenna and from any property which is zoned or used for <br />residential purposes. <br /> <br /> (d) Screening pursuant to this section shall be done <br />through landscaping whenever practical. Screening other than <br />landscaping shall be architecturally integrated with the build- <br />ing(s) on the property. <br /> <br />SECTION 3: If any section, subsection, sentence, clause, <br />phrase or portion of this Ordinance is for any reason held to <br />be invalid or unconstitutional by the decision of any court <br />or competent jurisdiction, such decision shall not affect the <br />validity of the remaining portions of this Ordinance. The City <br />Council of the City of Santa Ana hereby declares that it would <br />sentence, clause, phrase, or portion thereof irrespective of the <br />fact that any one or more sections, subsections, sentences, <br />clauses, phrases, or portions be declared invalid or uncon- <br />stitutional. <br /> <br />SECTION 4: Neither the adoption of this Ordinance nor the <br />repeal hereby of any ordinance shall in any manner affect the <br />prosecution for violation of ordinances, which violations were <br />committed prior to the effective date hereof, nor be construed <br /> <br /> <br />
