ORDINANCE NO. NS-1810 <br />PAGE THREE <br /> <br />carried on thereunder when in violation of this code or of any <br />other ordinance or from revoking any certificate of approval when <br />issued in error. <br /> <br /> Every permit issued by the administrative authority <br />under the provisions of this code shall expire by limitation and <br />become null and void, if the work authorized by such permit is not <br />commenced within one hundred eighty (180) days from the date of <br />such permit, or if the work authorized by such permit is suspended <br />or abandoned at any time after the work is commenced for a period <br />of one hundred eighty (180) days. Before such work can be <br />recommenced a new permit shall be first obtained to do so, and the <br />fee therefor shall be the amount required for a new permit for <br />such work, provided no changes have been made, or will be made in <br />the original plans and specifications for such work; and provided, <br />further, that such suspension or abandonment has not exceeded one <br />year. Applications for which no permit is issued within one hun- <br />dred eighty (180) days following the date of application shall <br />expire by limitation, and plans and other data submitted for re- <br />view may thereafter be returned to the applicant or destroyed by <br />the building official. In order to renew action on an application <br />after expiration, the applicant shall resubmit plans and pay a new <br />plan review fee. <br /> <br />SECTION 4: If any section, subsection, sentence, clause, <br />phrase or portion of this ordinance is for any reason held to be <br />invalid or unconstitutional by the decision of any court of compe- <br />tent jurisdiction, such decision shall not affect the validity of <br />the remaining portions of this ordinance. The City Council of the <br />City of Santa Ana hereby declares that it would have adopted this <br />ordinance and each section, subsection, sentence, clause, phrase <br />or portion thereof irrespective of the fact that any one or more <br />sections, subsections, sentence, clauses, phrases, or portions be <br />declared invalid or unconstitutional. <br /> <br />SECTION 5: Neither the adoption of this ordinance nor the <br />repeal hereby of any ordinance shall in any manner affect the <br />prosecution for violation of ordinances, which violations were <br />committed prior to the effective date hereof, nor be construed as <br />affecting any of the provisions of such ordinance relating to the <br />collection of any such license or penalty or the penal provision <br />applicable to any violation thereof, nor to affect the validity of <br />any bond or cash deposit in lieu thereof, required to be posted, <br />filed or deposited pursuant to any ordinance and all rights and <br /> <br /> <br />
