250. q <br /> <br />is needed, Developer shall install said traffic signal <br />at Developer's expense. <br /> <br /> (4) Transportation Demand Management <br />Program. The Developer agrees to comply with the <br />Transportation Demand Management Program as set forth <br />in the draft EIR, as modified in the Response to <br />Comments portion of the EIR. <br /> <br /> (5) Non-Traffic Mitigation Measures. The <br />Developer agrees to comply with the non-traffic <br />mitigation measures, of Developer as set forth in the <br />draft EIR, as modified in the Response to Comments <br />portion of the EIR. <br /> <br />10. Costs of Mitigation Measures. <br /> <br />(a) City's Obligations. <br /> <br /> Except as expressly provided below, the Developer <br />shall not be obligated to pay the cost for any public <br />improvements required to be designed and constructed by <br />the City as set forth above in Section 9(a). The cost <br />of all such public improvements shall be the sole <br />responsibility of the City or other applicable party. <br /> <br />(b) Developer's Obligations. <br /> <br /> (1) Monorail Study. The Developer agrees to <br />contribute Fifty Thousand and No/100 Dollars <br />($50,000.00) towards the study of a monorail system for <br />the City within forty-five (45) days after demand by <br />the City. The obligation to make such contribution <br />shall be subject to the requirement that the City <br />initiate such a study and provide or obtain the balance <br />of the funding necessary for such a study. <br /> <br /> (2) Cabrillo Park Drive. The Developer shall be <br />obligated to bear all costs and expenses in connection <br />with the acquisition, design and construction of <br />Cabrillo Park Drive between First and Fourth Streets <br />including the portions previously constructed as well <br />as portions required to be constructed pursuant to the <br />terms of this Agreement. The City and Developer have <br />established a benchmark for the total cost to acquire, <br />design and construct the Cabrillo Park Drive <br />Improvements so as to extend Cabrillo Park Drive to <br />Fourth Street of One Million Five Hundred Seventy-Five <br />Thousand and No/100 Dollars ($1,575,000.00). This <br />benchmark includes the cost of acquisition of the <br />remaining right-of-way not previously dedicated and the <br />design and construction costs for the Cabrillo Park <br />Drive Improvements as defined in Section 9(b)(1) which <br />includes the street improvements to complete Cabrillo <br />Park Drive between First and Fourth Streets adjacent to <br /> <br /> <br />
