General Provisions. <br /> <br /> (a) Waiver. A waiver of any default or failure to <br />enforce any provision of this Agreement by either party <br />shall not constitute a waiver of any subsequent default or <br />prevent the enforcement of the same or other provision at <br />any subsequent time. <br /> <br /> (b) Severability. In the event that any provision of <br />this Agreement shall be held to be invalid by a court of <br />competent jurisdiction, such holding shall not invalidate or <br />render unenforceable any other provision hereof. Further, <br />in the event any approval or action by the City in connec- <br />tion with this Agreement is held to be invalid by a court of <br />competent jurisdiction, to the fullest extent permitted by <br /> <br />- 18 <br /> <br /> <br />
