<br />ORDINANCE NO. NS-2106 <br /> <br />09!1 <br /> <br />(the "Sandpointe Improvements contribution"). Payment of the <br />Sandpointe Improvements contribution shall be made prior to the <br />issuance of a building permit for the office building. <br /> <br />(b) Obliqations of the citv for Mitiqation <br />Measures. The city agrees to use the Off-site street Improvements <br />contribution to fund the measures required to mitigate the adverse <br />environmental impacts which are identified in the EIR and which <br />pertain to off-site traffic, circulation, and roadway and street <br />improvements and to do so in a reasonably expeditious manner as <br />sufficient funding becomes available. Included among the areas to <br />be improved are the following: <br /> <br />i) Intersections: <br /> <br />MacArthur Boulevard - Main street; <br /> <br />MacArthur Boulevard - SR-55 SB Ramps; <br /> <br />MacArthur Boulevard - SR-55 NB Ramps; and <br />MacArthur Boulevard - Hutton Centre Drive. <br /> <br />MacArthur Boulevard - Red Hill Avenue <br /> <br />ii) streets: <br /> <br />MacArthur Boulevard; and <br /> <br />Sunflower Avenue. <br /> <br />The City also agrees to use the Traffic Monitoring contribution and <br />the Sandpointe Improvements Contribution for the purposes stated <br />above in subsection (a) (i v) of this section and to do so in a <br />reasonably expeditious manner depending on the availability of <br />sufficient funding and on priorities established jointly by the <br />city and the Sandpointe neighborhood association. Except for the <br />payment of the Off-site street Improvements contribution, the <br />Traffic Monitoring Contribution, and the Sandpointe Improvements <br />contribution, Developer shall have no obligations concerning the <br />implementation or the funding or the construction of any measure <br />required to mitigate any adverse environmental impact pertaining to <br />off-site traffic and circulation and off-site street improvements, <br />except for the payment of taxes, assessments, and fees established <br />by ordinance of the City Council, the revenues of which may be used <br />for such purposes; provided, however, that in the event of the <br />formation of a special assessment district which is"designed to <br />raise revenue to pay for any of the costs of the abovesaid off-site <br />street improvements and which results in an assessment on the <br />Property, Developer or its successor in interest in the Property <br />shall receive credit for the payment of the assessment on the <br />Property to the extent of the Off-site street Improvement <br /> <br />9 <br />
