x07 <br /> <br />ORDINANCE NS-2193 <br /> <br />4. Residential Space. <br /> <br />427,660 square feet comprised of 216 units of high-rise <br />condominium and 64 units of attached single family <br />housing. This density reflects a site wide maximum <br />aggregate density of 16 Dwelling Units per acre. A <br />minimum of 6.1 acres of the site shall be devoted to <br />residential uses, provided such 6.1 acres may be <br />parcelized into any number of parcels. <br /> <br />5. Hotel/Conference Space. <br /> <br />315,475 square feet comprised of a minimum of 250 hotel <br />rooms (including suites) and a minimum of 11,000 square <br />feet of associated restaurant space, 20,000 square feet <br />of convention facilities/meeting/banquet rooms, and <br />30,000 square feet of support retail. <br /> <br />Density Conversion. <br /> <br />Upon application to the Planning Department and approval by <br />the city Council, the developer may seek to convert square <br />footage allocated to a particular land use category to <br />another category. Such conversion may be granted only if all <br />of the following requirements are met: (i) the developer <br />establishes that the environmental impacts associated with <br />the revised square footage allocation are less than or equal <br />to the impacts associated with the development permitted by <br />this Plan, (ii) developer has completed a minimum of 548,392 <br />square feet of Professional and Business office space, 86,580 <br />square feet of retail space, 8,280 square feet of restaurant <br />space, a cineplex/community theater, and a health club and <br />(iii) there will be no increase in residential density. <br /> <br />CC&Rs. <br /> <br />Reciprocal easements and Conditions, Covenants, and <br />Restrictions (CC&RS) tying the overall project together as an <br />integrated development and providing for joint access, <br />ingress, egress, drainage, property maintenance standards, <br />trash pick-up operations, circulation and parking management <br />shall be recorded with the first final map prior to for the <br />first phase of development. The residential and non- <br />residential portions may be described in separate sections <br />but they must be tied together by a single master document. <br />The Master CC&R's shall address trash and reciprocal use <br />rights in Phase I and Phase II for the residential and <br />commercial uses. <br /> <br />8 <br /> <br /> <br />
