ORDINANCE NS-2231 <br />Page 2 <br /> <br />opinions of the Court of Appeal and the Superior Court; <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES <br />ORDAIN AS FOLLOWS: <br /> <br /> SECTION 1: That certain "Report of the Executive Director of <br />the Community Development Agency to the city Council on the Bristol <br />Corridor Redevelopment Project," dated August 5, 1994 (the "Execu- <br />tive Director's Report"), submitted to the City Council for its <br />August 15 regular meeting, is hereby approved and adopted by the <br />City Council as its findings and conclusions with respect to the <br />matters set forth therein. <br /> <br /> SECTION 2: That paragraph (i) of Section 3 of Ordinance No. <br />NS-2039 is amended to read as follows: <br /> <br /> i) There are, or are being provided, within the Project Area <br />or within other areas not generally less desirable with regard to <br />public utilities and public and commercial facilities and at rents <br />or prices within the financial means of the families and persons <br />who might be displaced from the Project Area, decent, safe, and <br />sanitary dwellings equal in number to the number of and available <br />to such displaced families and persons and reasonably accessible to <br />their places of employment. This finding is based upon the facts <br />set forth in the Executive Director's Report. <br /> <br /> SECTION 3: That paragraph (j) of Section 3 of Ordinance No. <br />NS-2039 is amended to read as follows: <br /> <br /> j) Inclusion of any lands, buildings, or improvements which <br />are not detrimental to the public health, safety or welfare is <br />necessary for the effective redevelopment of the entire area of <br />which they are a part, and any such area is not included solely for <br />the purpose of obtaining the allocation of tax increment revenues <br />from such area pursuant to Section 33670 of the Community Redevel- <br />opment Law without other substantial justification for its <br />inclusion. This finding is based upon the facts set forth in the <br />Executive Director's Report. <br /> <br /> SECTION 4: If any section, subsection, sentence, clause, <br />phrase or portion of this ordinance is for any reason held to be <br />invalid or unconstitutional by the decision of any court of <br />competent jurisdiction, such decision shall not affect the validity <br />of the remaining portions of this ordinance. The city Council of <br />the City of Santa Ana hereby declares that it would have adopted <br />this ordinance and each section, subsection, sentence, clause, <br />phrase or portion thereof irrespective of the fact that any one or <br />more sections, subsections, sentences, clauses, phrases, or <br />portions be declared invalid or unconstitutional. <br /> <br />2 <br /> <br /> <br />
