Ns-2 3 7 3 <br /> <br />AN ORDINANCE OF THE CITY OF <br />SANTA ANA AMENDING AND ADDING <br />VARIOUS PROVISIONS OF THE SANTA <br />ANA MUNICIPAL CODE REGULATING <br />LAND USES AND CREATING A NEW <br />ARTICLE FOR REGULATION OF ADULT <br />ENTERTAINMENT BUSINESSES <br /> <br />The City Council of the City of Santa gna ordains as follows: <br /> <br />SECTION1. FINDINGS <br /> <br /> The City Council of the City of Santa gna ("the City") f'mds, determines <br />and declares: <br /> <br /> A. This Ordinance is necessary in order to revise and update certain <br />provisions of the City's Municipal Code relating to adult entertainment businesses in <br />order to respond to recent developments in the regulation of expressive and adult <br />entertainment businesses and case law interpretation. The City Council finds and <br />determines that this Ordinance is necessary to establish reasonable and uniform <br />regulations that will reduce the adverse secondary effects that adult entertainment <br />businesses have upon the residents of the City and that it is evident that special zoning <br />regulations applicable tO adult entertainment businesses are necessary to preserve the <br />integrity of existing commercial areas of the City and of residential areas which are in <br />close proximity to such commercial areas. The public health, safety and welfare of <br />the City requires the enactment of this Ordinance. <br /> <br /> B. The City Council further finds and determines that this Ordinance <br />is necessary in order to preserve the City from the potential secondary effects of adult <br />entertainment businesses including crime, the protection of the City's retail trade, the <br />prevention of the blighting of neighborhoods and the maintenance of property values, <br />protecting and preserving the quality of the City's neighborhoods and the City's <br />commercial districts, the protection of the City's quality of life, the increased threat of <br />the spread of sexually transmitted diseases, and the protection of the peace, welfare <br />and privacy of persons who patronize adult businesses.
