<br /> the grades to which said improvements are to be construed
<br /> shall be those set forth in said Resolution of Intention
<br /> No. 2260, and in the specifications therein referred to,
<br /> reference to which is hereby made.
<br /> 4. That the City Attorney of the City of Santa Ana is
<br /> hereby by ordered to commence a proceeding before the
<br /> Railroad Commission of the State of California as requir~
<br /> by the laws of the State of California to have fixed the
<br /> Just compensation to be paid for any property damaged in
<br /> the partial separation of grades as proposed in said Reso.
<br /> lution of Intention as to those owners who filed protests
<br /> against the Change of grade proposed in said Resolution
<br /> of Intention in the manner provided in said Acquisition
<br /> and Improvement Act of 1925, and to do all things neces-
<br /> sary to prosecute said proceeding to final determination.
<br /> 5. That the time hereby fixed for receiving bids for
<br /> the d oing of said work and improvements herein ordered is
<br /> ~he 16th day of February, 1931, at the hou~ of 7:30
<br /> o'clock P.M., and the Clerk of this City Council is hereb
<br /> ordered to post and to publish in the newspaper designa-
<br /> ted in said Resolution of Intention No. 2260, a notice
<br /> inviting sealed bids, requiring in such notice that all
<br /> bids shall be accompanied by a certified check or bond,
<br /> all as required ~y the provisions of Sec~ on 12 of the
<br /> Acquisition and Improvement Act of 1925, as amended.
<br /> 6. T~at to defray the expenses of the work and improve
<br />ments herein ordered, and any damages allowed by the Rail-
<br />road Commission of the State of California for property
<br />damaged in said partial separation of grades as proposed
<br />in said Resolution of Intention, bonds will be issued to
<br />the total amount of the same, said bonds to bear interest
<br />at the rate of six percent per annmn, payable semi-annuaH
<br />the first interest payment to be made on the 2nd day of
<br />January, or the ~nd day of July (whichever month first
<br />succeeds the date of the bonds) next succeeding one year
<br />after the date of such bonds, and the aggregate principal
<br />of all bonds issued under these proceedings to be paid
<br />and discharged within twenty-three (23) years after the
<br />date of issuance, approximately one-twentieth part of Z~cl
<br />aggregate principal to be paid annually, all in gold coin,
<br />and that a special fund for the payment of said bonds wilS
<br />be constituted by the lovy of special assessment taxes
<br />upon the lands within the Assessment District, in accord-
<br />ande with the provisions of the Acquisitio~ and Improve-
<br />ment Act of 1925, and amendments thereto, according to th~
<br />assessed value of such lands, exclusive of the improve-
<br />ments thereon, except as otherwise in said Act provided.
<br />That the first payment on the aggregate principal of the
<br />bonds issued will be made three years after the issuance
<br />thereof.
<br /> 7. That the proceedings for said work and improvements
<br />shall be had and taken under and in ~ccordance wi~h an
<br />Act of the Legislature of the State of California, known
<br />and designated as the Acquisition and Improvement Act of
<br />1925", approved May ~3~ 1925, and amendments thereto, and
<br />said bonds shall also be issued in accordance with the
<br />provisions of said Act.
<br /> The foregoing Resolution was duly and regularly intro-
<br />duced, passed and adopted by the affirmative vote of all
<br />five members of the City Council of the City of Santa Ana,
<br />at a regular meeting thereof, held on the 19th day of
<br />January, 1931, by the following vote, to-wit:
<br /> Ayes, Trustees J.L. McBride, W.J. Kelly, B.0. Sutton,
<br /> Stanley E. Goode, F.L. Purinton.

<br />ried, the City Council adjourned to Monday, January 26th,
<br />1931, at 7:30 P.M., in the Council Chamber.
