10 <br /> <br />Santa Ana City Hall. <br /> <br />January Zlst, 1935. 7:30 P.M. <br /> <br />City Council met in regular session. <br /> <br />Meeting called to order by Mayor Warner. <br /> <br />Present: Trustees Fred C. Rowland, W.H. Penn, <br />Plummet W. Bruns, E.G. Warner. <br /> <br />Absent: Trustees A.F. LeGaye. <br /> <br />Minutes of meetings of January Vth and 14th <br /> were approved as read. <br /> <br />In Re <br /> <br />The resignation of'Trustee A. F. LeGaye was read as follows: <br /> <br />Resignation <br /> <br />Trustee A.F. <br /> <br />LeGaye. <br /> <br />TO THE HONORABLE CITY COUNCIL, <br />Santa Ana, California. <br /> <br />Gentlemen: <br /> <br />lng of a City <br />as authorized <br />authority. <br /> <br /> After consultation with two prominent attorneys of <br />Los Angeles who are well versed in Municipal Law, I have <br />decided that - <br /> 1st - That there is a grave question as to the <br />legal status of the present City Council for the reason that <br />four members of the Board are appointees and are acting as <br />De Facto officers only. T~his was plainly brought to our <br />notice by the refusal of the Bond Attorneys to certify to <br />the validity of the bombs for the building of the City Hall <br />until a special meastt~e was passed by the Legislature. And <br />it will be remembered that the opinion of the bond attorney, <br />supp~ted the opinion of our own city attorney, who said the <br />Councilmen who had been appointed should be elected at the <br />November election. However, the advice of outside attorneys <br />was followed, with the result of being forced to go to Sacra <br />mento to get our acts validated. <br /> 2nd - That the letting of a contract for the build <br /> Hall for an amount in excess of the $100,000, <br /> by vote of the people, is going beyond our <br /> <br /> 3rd - That the purchase of land by the Council at <br />a price many times in excess of its real value is a question <br />able act and is subject to Just criticism by the taxpayers, <br />whose money we are spending. <br /> After giving careful consideration to the above <br />items, together with many others, I have arrived at the con- <br />clusion that -- <br /> The acts of the City Council might be subject to <br />attack by any citizen of Santa Aha, and that I as a member <br />of the Council might incur a personal liability by being a <br />party to such acts. I do not care to take this chance. <br /> On the advice of my attorney I am resigning from <br />the Council, my resignation to take effect immediately. <br /> I ask that this resign.'tion, together with the <br />reasons as given therefor, be incorporated in the minutes <br />of this meeting. <br /> Yours respectfully, <br /> <br />Santa Ana, Cal. LeGaye as Trustee of the First Ward <br /> <br />was accepted. <br /> <br />In Re <br /> <br />Application <br /> <br />Unite~ Cooperative <br /> <br />A communication of the United Cooperative Exchange #1 was <br />'read requesting permission to use the property located on <br />First Street Just east of Sullivan Street, Santa Aha, for <br /> <br />Exchange ~1. <br /> <br />gardens for this year, rent free. On motion of Trustee <br /> <br />Bruns, seconded by Penn and carried, the Chair was authorize <br /> <br />to appoint a committee to meet with Newell A. Lucas,Presiden <br /> <br />of the Exchange and Otto McClure, caretaker of the land at <br />the present timer and report back at the next meeting. <br />Trustees Bruns and Rowland were appointed as the committee. <br /> <br /> <br />
