Council Chamber <br /> <br />Santa Ana City Hall. <br /> <br />June 19th, 1941. 1:00 P.M. <br /> <br />City Council met in regularly adjourne~ and <br />specially called meeting, for the purpose of <br />taking action on the leasing of certain real <br />property known as the Berry Rancho and all <br />other business which may legally'come before <br />City Council. <br /> <br />the <br /> <br />Meeting called to order by Mayor Bruns. <br />Present: Trustees Herbert L. Hill,~ E. D. Yost, <br /> D. W. Kelsey, Plummer W. Bruns. <br /> Absent: Trustees Joseph P. Bmith. <br /> <br />In Re <br /> <br />On motion of Trustee Kelsey, seconded by Hill aha carried, <br /> <br />Recess. <br /> <br />a recess was taken for thirty minutes. <br /> <br />Trustee Bmith appeared at the Council meeting and the City <br /> <br />Council called to order. <br /> <br />In Re <br /> <br />Bite for Flying <br /> <br />Cadet Replacement <br /> <br />Base. <br /> <br />Trustee Kelsey gave an explanation for the present meeting, <br />stating that Colonel Glenn, Major Tull and Major Bailey and <br />members of the City Council had investigated several sites <br />for the location of a Flying Cadet Replacement Base, among <br />them being the Berry Rancho on Newport Boulevard adjacent <br />to the intersection of Paularino Road. It was stated that <br />there was a definite interest shown by the Army officials <br />for the Berry Rancho, consisting of 411.95 acres, providing <br />certain requirements could be made as follows: <br /> 1. Lease. (a) 25 year with option to purchase --~ <br /> '(b) Including wells on propertyJ <br /> 2. Clear mineral rights or obtain waiver of mineral <br /> privileges during lease period. <br /> (s) Certificate from Department of Interior. <br /> 3. Proper proceedings by Coundil showing authority to <br /> negotiate. <br /> 4. Certificate of ownership of property or Title Insurance <br /> Policy. <br /> 5. Public utility commitments. <br /> /~I Telephone Company, at least six lines. <br /> ~' Gas Company--specifications already relayed <br /> to Fred Merke~,'Local ~Manager. <br /> (c)Elec'trlc Company--specifications relayed td <br /> Rodney Bacon, Local Manager. <br /> 8. Right of way for sewer line. <br /> 7. Commitments from Board of Buperviaors on County airport <br /> and hangar--need five acres--separate lease between the <br /> County of Orange and U.S. Government. <br /> 8. Right of way from Baker Btreet over either Lot 13 or <br /> 9. Eight county maps as exhibits. <br /> <br />Attorney George Tobias explained receiving an option to leas~ <br />and an option to purchase the Berry Rancho from M.H. Whittier <br />Company, Etd., which affords the City of Banta Ana 120 days <br />within which to enter into a lease and option to purchase <br />said land at a yearly rental price of $15.80 per acre per <br />year, the Oity to pay the taxes assessed against the property <br />during the rental periods, the lease calling for a year <br />period with option to renew from year to year for a total <br />period of twenty-five years. The option to purchase at any <br />time with the twenty-five years is at a price of $800.00 per <br />acre. Lease was not assignable and the City could sub-let <br />only to the United Btates Government for military purposes, <br />with like option to lease from year to year for a twenty- <br />five year period and an option to purchase. The annual rental <br />due the Whittier Company would be $~8.00. Whittie~ Compan~ <br />reserves the mineral rights on a fifty-fifty Oasis, only in <br />case the option to purchase was exercised by the City alone; <br />if the ~.B. Government un, er the sublease exercises its <br />option to purchase, all mineral rights reserved by lessor <br />shall be conveyed to the City and in turn to the U.B. Govern~ <br />merit. The annual re~tal value of $830~.00, provided option <br />to lease is exercised is to be paid in advance on the first <br />of August~; and ~he City is' boun~ to exercise its option to <br />renew th~ lease if the GoVernment 'has e~ercis~d its option. <br />It was next explained that the present tenant was occupying <br />the property pursuant to a written lgase which would not end <br />until 19A9; that the tenant had now spent $~A00.00 on the <br />present crop and asked $~800.00 to surrender the lease and <br />that hie additional costs would be $800.00 between now and <br />August lat. In order to dispossess the tenant by ~ugust <br />the amount of $8700.00 was stipulated as a pay-off tO b'e <br />equally divided between Whittier Company and the City. <br /> <br /> <br />
