No~ Z954 <br /> <br />AUthorizing Execution of <br /> <br />Option-M.H.~tler Company. <br /> <br />If possession is needed prior to Augua~ 1st and amount <br />equivalent to $25.00 per day for the unexpired time shall be <br />deducted from the $6700.00; any salvage on the crop harves- <br />ted shall be divided equally between the City and Whittier <br />Company. If possession is not required until after August <br />1st the tenant.shall Deceive $25.00 per day in addition to <br />the $6700.00 for such time, less any amount obtained through <br />salvage or harvest of the crop. The option also provided <br />that if the Government leased the property for less than <br />five years the unexpired proportion of Whittier Company's <br />share of the tenant's pay-off must be paid by the City to <br />Whittier Company. The lease from Whittier Company was to <br />cover the entire acreage plus the two existing wells with <br />its machinery and equipment. The present improvements are <br />to b$ removed by the Whittier Company at its expense. Any <br />buildings and improvements placed on the property by the <br />City.or the Government are to be removed within ninety days <br />after the expiration of the leasing terms. <br /> <br />Trustee Smith expressed his objections as follows: <br />Objected to the City renting the property for $15.50 per <br />acre or paying any other sum whatsoever; also objected to <br />binding the City for a twenty-five year period in the face <br />of its inability to obtain such an amount through taxation <br />or otherwise; also ~Je~ to the City assuming the taxes <br />estimated at $4.4~/~5~ ~ ~$riod of twenty-£ive years; <br />objected to assuming any taxes whatsoever in connection with <br />the property; objected to the payment of any damage or ~onus <br />to the tenant on the property in order to obtain immediate <br />possession; objected to the City becoming obligated for a <br />period of twenty-five years for the rental of this property; <br />objected to the price and the option to purchase of $500.00 <br />per acre; objected to the lease itself and the lease general] <br /> <br />Discussion was l~en had as to the leasing of other property <br />and Trustee Kelsey and Attorney Tobias stated that the pro- <br />perry in question was the only property which would be con- <br />sidered by the Government officials and that the best posSi- <br />ble deal was obtained from Whittier Company by its option <br />already explained; that attempts had been made to secure <br />other property which would ~eet with the approval of the <br />Government and that attempts had been made to decrease the <br />rentals and obligations under the Whittier Company lease but <br />both had proved futile. <br /> <br />Trustee Kelsey objected to Trustee Smith referring to the <br />lease for a twenty-five year period and stated that it was <br />merely a lease for one year with the privilege of renewing <br />from year to year for a period of twenty-five years; also <br />stating that the City is not obligating itself to pay the <br />taxes for twenty-five years but only in the event that the <br />lease ie renewed year after year for a total of twenty-five <br />years. <br /> <br />Trustee Yost a~d Trustee Hill both expressed their opinions <br />that the option tendered by Whittier Company and the o <br />ity afforded the City to deal with the Government in this <br />project would prove highly beneficial to the City and the <br />public generally. <br /> <br />Mr. F. A. Jones, rApresen$ing the Santa And Chamber of Com- <br />merce, gave an expression of the organization he represented <br />and of the business men generally, ~hat the Council should <br />enter into the negotiations with both the Whittier Company <br />and the Government as had been explained. <br /> <br />On motion of Trustee Yost, seconded by Hill and carried, <br /> <br />the following Resolution entitled: <br /> <br />"R~solution Accepting Option of M. H. Whittier Company, <br />Ltd. and Authorizing Payment of Consideration" <br /> <br />was read, considered, designated Resolution No. 2953 end <br /> <br />passed by.~he following vote: <br /> <br />Ayes, Trustees Herbert L. Hill, Joseph P. 6mith, E. D. Yost <br /> D. W. Kelsey, Plummet W. Brune. <br /> <br />Noes, Trusteee None. <br /> <br />Absent/ Trustees None. <br /> <br />On motion of Trustee Yost, seconded by Hill and carried, the <br /> <br />following Resolution entitled: <br /> <br />"Resolution Authorizing Execution Of Option" <br /> <br /> <br />
