<br />The Mayor announced that the City Engineer, who prepared the
<br />
<br />report ordered by Resolution No. 3833 will read all of said
<br />
<br />report, except as to the map of the proposed assessment district
<br />
<br />and the assessed valuations and true valuations of and assessment
<br />
<br />and estimated assessments upon each parcel of land in the propose
<br />
<br />assessment ~strict. On motion of Trustee Reed, seconded by
<br />
<br />Cheney and carried, the ~ebt Limit Report, as read by the City
<br />
<br />Engineer, was approved.

<br />The Mayor asked if any written protests or objections have been
<br />
<br />filed in this matter. The Clerk announced that no written
<br />
<br />protests had been received. Mr. William C. Knudson, 2111 Kilson
<br />
<br />Drive, requested certain information as to payment of costs of
<br />
<br />assessment district. Mr. Glen Shaw, 2061 Halladay St. requested
<br />
<br />information concerning manner in which payments may be made.

<br />Mrs. Pearl Nelson, 2046 Oak St. asked when project would be starte
<br />
<br />All questions were answered by the City Engineer. No oral protes
<br />
<br />were made, and no other persons indicated a desire to be heard.

<br />On motion of Trustee Reed, seconded by Cheney and carried, the
<br />
<br />hearing was ordered closed and the following Resolution entitled:
<br />"Resolution of the City Council of the City of Santa
<br /> Ana, California, determining results of hearing;
<br /> overruling protests; determining that the public
<br /> interest, convenience and necessity require certain
<br /> work or improvement substantially as set forth in
<br /> report on project filed under the special assessment
<br /> investigation, limitation and majority protest Act
<br /> of 1931; determining that said project is feasible
<br /> and making other determinations"
<br /> WHEREAS, this City Council has heretofore, on August 22, 19~9, by
<br /> Resolution No. 3833, taken the steps provided by Sections 2821,
<br /> 2822 and 2823 of the Streets and Highways Code of the State of
<br /> Califo~nia (said sections being a part of the Special Assessment
<br /> Investigation, Limitation and Majority Protest Act of 1931) for
<br /> certain work or improvement consisting of certain proposed
<br /> sanitary sewer and water work in the City of Santa Ana, California
<br /> and
<br />WHEREAS, by said Resolution No. 3833, this City Council directed
<br />the City Engineer to procure the required information and prepare
<br />and present to this City Council the written report on said work
<br />and improvement required by the Special Assessment Investigation,
<br />Limitation and Majority Protest Act of 1931 as set forth in
<br />Division 4, Part 2, Sections 2824 to 2830, inclusive, of said
<br />Streets and Highways Code; and
<br />WHEREAS, said report has been presented to this City Council and
<br />approved and ordered filed by this City Council; and
<br />WHEREAS, by Resolution No. 383~, adopted on the 22nd day of August
<br />19~9, this City Council fixed a time and place for hearing by it
<br />on said report; and
<br />WHEREAS, notice of said hearing was mailed as required by said
<br />Special Assessment Investigation, Limitation and Majority Protest
<br />Act of 1931; and
<br />WHEREAS, at the time and place so fi~ed a hearing was duly held
<br />by this City Council at which all written protests or objections
<br />which were presented were read, and all persons desiring to be
<br />heard thereon were heard, and this City Council gave all persons
<br />present an opportunity to be hee~-d in respect of any matter
<br />relating to said report, said work or improvement, or any of the
<br />proceedings therefor; and
<br />WHEREAS, all persons desiring to appear and be heard were heard at
<br />said hearing and said hearing has been closed; and
<br />WHEREAS, this is the time and place for consideration of said
<br />report, and this City Council has considered said report and is
<br />fully informed in the premises;
<br />NOW, THEREFORE, the City Council of the City of Santa Ana DOES
<br />HEREBY RESOLVE, FIND, DETERMINE AND ORDER as follows:
<br />Section 1. That said report contains all the matters and things
<br />required by law and that notice of hearing on the proposed project
<br />generally described therein has been duly and regularly given.
<br />Section 2. That no written protests have been filed with the Cle~
<br />of this City Council or at all by the owners of one-half of the
<br />area of the property to be assessed f&r said proposed work or
<br />improvement and that there is no majority protests as provided in
<br />Section 2931 of the Streets and Highways Code, against only a
<br />portion of said proposed work or improvement.
<br />Section 3. That all protests and objections be and the same are
<br />hereby overruled and denied.
