Robert Phillips appeared before the Council and presented petitioz containing signatu~es of forty-seven property owners on Palm St. pretesting parking of cars of Case-Swayne employees, noise of machinery, odor emanating from unenclosed conveying machinery, water and food refuse in alley between Palm and Fourth Streets, and objecting to trucks being left unattended. Trustee Reed was appointed to inves~igate matter reference to health angle. On motion of Trustee Chand~4er, seconded byReed and carried, petitioz was received and filed. Michael C. Gordon protested trucks blocking the alley and matter was referred to the Chief of Police for investigation. Claude Hunter objected to odors, noise and refuse. # On motion of Tx-ustee Chandler, seconded by Martin and carried, statement of claim of M.P.NcOaff~ey, Inc. for rental of equipment to Stan Laaarevich, contractor, in the amount of $1691.53, was referred to the-City Attorney. # On motion of Trustee Martin, seconded by Reed and oarrie~, proper authorities were authorized to execute bill of Sale of Western Uni Telegraph Co., in the amount of $1.00, dated October 2?th, 1949, wherein the City will obtain five of the former Postal Telegraph Company's poles located along-Terminal Street to accommodate fire alarm facilities. # On motion of Trustee Reed, seconded by Cheney and carried, Resolutions of Ora-ge, Fullerton and Anaheim terminating contract permitting Newport Beach to use the submarine tube extending into the Pacific Ocean were received, filed and Clerk instructed to notify City of Newport Beach of cancellation of Joint Outfall Sewer contract. # Ne written or oral protests having been received, ~n mstablishing a set-back line on both sides of East Washington Ave. between Lincoln and Grand Avenues, on motion of Trustee Cheney, seconded by Chandler and carried, the City Attorney was instructed to prepare necessary Ordinance. # On motion of T~ustee Chandler, seconded by Cheney and carried, the following Ordinance entitled~ #An 0rdi-~nce establishing set-back lines on a portion of East Washington Avenue, 30 feet on each side of the center line of said East Washington Avenue from the east line of Lincoln Avenue to the west line of Grand Avenue" was introduced, read, considered and placed on file for second reading. On motion of Trustee Chandler, seconded by Oheney and carried, the 01erk was authorized to advertise for bids for 955 ft. 3N, 620 ft. 2# and 2255 ft. 1" water pipe; three 50 EVA transformers and labor and equipment required to pull and dispose of from 900 to 1200 orange trees at Prentice Park; bids to be opened Dec. 5th 1949. # ~n
