I hereby certify that the foregoing Resolution is a full, true and correct copy of Resolution of Award No.1059, duly introduced and regularly passed by the Board of Trustees of the City of Santa Aha at a regular adjourned meeting there- of held on the 13th day of August, 1923, by the following vote: C. Whereas, a certain claim for $520.00, arising out of and by reason of the alleged negligence of the City of Santa Aha and their contractor, B. R. Ford, in the construc- tion of the outfal! sewer between the 1st and 12th days of July, 1923, as a result of which alleged negligence the pro- perty of S. Nitta is alleged to have been damaged has been filed with the Board of Trustees of the said City. Be It Hereby Resolved, that the City of Santa Ana rejects the claim and denies any liability of any kind or character by reason of the acts alleged in s~d claim, and that the City Attorney be instructed to take such steps as are necessary to protect the said City in case legal action is commenced against said City.
