RESOLUTION NO. 58-13 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA SETTING A HEARING FOR THE PURPOSE OF DETERMINING WHETHE~ OR NOT THE PUBLIC CONVENIENCE AND NECESSITY ~EQUIRE THE IMPROVEMENT OF DELHI ROAD AHD ~, ALL WITHIN THE CITY OF SANTA WHEREAS Section 17 of Artt$~ XIII of the Constitution of the State of California provides t~t the debt limitation and majority protest provisions of after the giving of such posting and the holding of such!i of the City of Santa Ana shall no less than a ~/5ths vote of ali shall not apply if, ~ation and the City Council raid council by · finds and determines that the public convenience and necessity ree/uire the improvement proposed to be made; and WHEREAS, Section 2804 of the Streets and Highways Code of the State of California provides that the "Special Assessment Investigation, Limitation and Majority Protest Act of 1931" shall not apply to any proceeding otherwise subject thereto when said improvement proceeding is by a charter city and said city has complied with the provisions of Section 17 of Article XIII of the Constitution of the State of California; and WHEREAS, the City of Santa Ana is a charter city of the State of California. NOW, THEREFORE, THE CITY COUNCIL 0F THE CITY OF SANTA ANA DOES RESOLVE AS FOLLOWS: SECTION 1. That said City Council proposes to initiate proceedings for the improvement of: Delhi Road between the center line of Main Street and a point 159.49 feet % east of the center line of Evergreen Street; -- Flora Street between the center line of Main Street and a point 330 feet $ east of the center line of Cypress Avenue;
