RESOLUTION NO. 58-139 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY 0F <br />SANTA ANA SETTZNG A HEARING FOR THE PURPOSE OF <br />DETERMINING WHETHER OR NOT THE PUblIC CONVENIENCE <br />AND NECESSITY REQUIRE THE IMPROVEMENT OF <br />ST. ANDREW PLACE AND OTHER STREETS, ALL WITHIN <br />THE CITY OF SANTA ANA <br /> <br /> WHEREAS, Section 17 of Article XIII of the Constitution of <br />the State of California provides that the debt limitation and maJor~ <br />ty protest provisions of said section shall not apply if, after the <br />giving of such reasonable notice by publication and posting and the <br />holding of such public hearing as the City Council of the City of <br />Santa Aha shall have prescribed, said Council by no less than a <br />4/5ths vote of all members thereof finds and determines that the <br />public convenience and necessity require the improvement proposed to <br />be made; and <br /> <br /> WHEREAS, Section 2804 of the Streets and Highways Code of <br />the State of California provides that the "Special Assessment Investi- <br />gation, Limitation and Majority Protest Act of 1931" shall not apply <br />to any proceeding otherwise subject thereto when said improvement <br />proceeding is by a charter city and said city has complied with the <br />provisions of Section 17 of Article XIII of the Constitution of the <br />State of California; and <br /> <br /> WHEREAS, the City of Santa Ana is a charter city of the <br />State of California, <br /> <br /> NO~, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ANA <br />DOES RESOLVE AS FOLLOWS: <br /> <br /> SECTION 1. That said City Council proposes to initiate <br />proceedings for the improvement of: <br /> <br /> Oak Street between Delhi Road and the north line of Tract <br /> No. 560; <br /> <br /> Kilson Drive between Delhi Road and the north line of <br /> Tract No. 560; <br /> <br /> Hickory Street between Delhi Road and the north line of <br /> Tract No. 560; <br /> <br />-1- <br /> <br /> <br />
